HOUSE RESOLUTION

 

Requesting the Department of Land and Natural resources to negotiate recreation-residence use leases in kokee with certain existing lessees.

 

 

WHEREAS, over the years the Territory of Hawaii and the State have been granting permits for recreational camp residences in the Kokee and Waimea Canyon State Park; and

WHEREAS, section 171-44, Hawaii Revised Statutes, provides the following:

"Notwithstanding any limitations to the contrary, the board of land and natural resources may lease, by direct negotiation and without recourse to public auction, lands within a state park or forest reserve and other lands set aside under executive orders, for recreation-residence use for a period not to exceed twenty years on such terms and conditions as may be prescribed by the board."; and

WHEREAS, there are now approximately one hundred forty recreation-residence use leases in the Kokee and Waimea Canyon State Parks; and

WHEREAS, the Board of Land and Natural Resources has directed the Department of Land and Natural Resources to conduct a public auction of all of its recreation-residence use leases in the Kokee and Waimea Canyon State Parks when their terms expire in 2006; and

WHEREAS, many of the existing lessees have made substantial improvements on their leased lots and do not want to abandon these improvements; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2006, that the Board of Land and Natural Resources is requested to allow the Department of Land and Natural Resources to negotiate a new lease with any existing lessee who has made improvements to the lessee's recreation-residence use lot and wishes to continue to lease a recreation-residence use lot at the Kokee and Waimea Canyon State Park; and

BE IT FURTHER RESOLVED that the Board of Land and Natural Resources is requested to publicly auction any lot that does not have an existing lessee that wishes to continue leasing the recreation-residence lot; and

BE IT FURTHER RESOLVED that a certified copy of this Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources.
