A BILL FOR AN ACT


 

 

relating to state facilities.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that public private partnerships are an effective tool in implementing state programs and projects.  Private entities who have partnered with the State to successfully build state facilities such as school buildings are valuable assets that should be encouraged. 

     The purpose of this Act is to improve the efficiency and effectiveness of public construction projects by authorizing a purchasing agency to enter into public-private partnerships for the construction of state facilities.

     SECTION 2.  Chapter 103, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§103-    Public-private partnerships; authorization.  (a)  Notwithstanding any law to the contrary, a purchasing agency may partner with a private entity for the construction of state facilities.

     (b)  The policy board shall adopt rules pursuant to chapter 91 to effectuate the provisions of this section."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon approval.
