A BILL FOR AN ACT


 

 

RELATING TO EDUCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to require the deposit of one per cent of general revenues into the newly created University of Hawaii repair and maintenance account for the funding of the repair and maintenance of university facilities.

     SECTION 2.  Chapter 36, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§36-    University of Hawaii repair and maintenance account.  (a)  There is created in the state general fund under UOH 900 (system wide support) the University of Hawaii repair and maintenance account.

     (b)  The following shall be deposited into the special account:

     (1)  One per cent of state general revenues;

     (2)  Interest earned on moneys in the account; and

     (3)  Any legislative appropriation.

     The director of finance shall deposit the amount reflecting the percentage of general revenues identified under paragraph (1) into the account on at least a semi-annual basis.

     (c)  The moneys in the account shall be appropriated and expended solely for the repair and maintenance of facilities of the University of Hawaii.  Expenditures from the account shall be subject to sections 37-31 and 37-33 to 37-40.

     (d)  Any unexpended and unencumbered appropriation at the close of the fiscal period for which appropriated shall lapse into the account and be available for appropriation and expenditure in ensuing fiscal years.

     (e)  This section shall not be construed as prohibiting the appropriation and expenditure of other sources of funds, such as general obligation bond funds, for the repair and maintenance of University of Hawaii facilities.

     (f)  The president of the University of Hawaii shall submit an annual report to the legislature no later than twenty days prior to the convening of each regular session.  The report shall include a financial statement of the University of Hawaii repair and maintenance account, the repair and maintenance projects undertaken during the immediate past fiscal year, and the planned repair and maintenance projects for the ensuing five fiscal years."

     SECTION 3.  Section 304A-2101, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  The general fund budget appropriations for the university shall be an amount not less than three times and not greater than five times the amount of regular tuition and related fee revenues estimated for that fiscal year[.]; provided that appropriations from the University of Hawaii repair and maintenance account of section 36-   shall be excluded from calculations to determine compliance with the required minimum and maximum general fund budget appropriations for the university."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2008.
