A BILL FOR AN ACT

 

 

RELATING TO WATER POLLUTION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 342D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§342D-    Total maximum daily load coordinator.  The department may establish not more than two exempt total maximum daily load coordinator positions.  The total maximum daily load coordinator positions, among other duties, shall assist the department to meet federal requirements for establishing total maximum daily loads in Hawaii.  This duty includes quantifying waste load allocations and load allocation limits on pollutant loading of Hawaii's inland and marine waters and developing technically based plans for achieving the State's stated water quality goals.  The positions shall be appointed by the director without regard to chapter 76.  These positions shall be funded by federal grants to the State under the Clean Water Act.  For purposes of this section, "Clean Water Act" means the Federal Water Pollution Control Act of 1972, P.L. 92-500 (33 United States Code Sections 1251 et seq.), as amended."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
