A BILL FOR AN ACT


 

 

relating to noise pollution.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 342F-31, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§342F-31[]]  Rules; specific.  (a)  The director may establish by rule:

     (1)  The control of vehicular noise; and

     (2)  Other specific areas for control of excessive noise, thereby allowing for varying conditions.

     (b)  The director shall establish rules requiring the use of mufflers on yard equipment, where applicable and as determined by the director to be necessary for the control of excessive noise.

     For the purposes of this subsection:

     "Muffler" means any device designed to reduce noise emitted by yard equipment.

     "Yard equipment" means any motorized device designed for landscaping or other outdoor grounds maintenance, and includes leaf blowers, lawn mowers, trimmers, and chainsaws."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
