A BILL FOR AN ACT

 

 

relating to cancer.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the Hawaii breast and cervical cancer control program was established in 1997 to provide breast and cervical cancer screening.  Since that time, the Hawaii breast and cervical cancer control program, administered by the department of health, and the breast and cervical cancer treatment program, administered by the department of human services, have worked together to help screen and treat low income, uninsured, but non-medicaid eligible women in Hawaii for breast and cervical cancer.

     Chapter 346, Hawaii Revised Statutes, was amended in 2001 to provide for a breast and cervical cancer treatment program to be administered by the department of human services for women who are not eligible for federally-funded medicaid coverage as provided by the Breast and Cervical Cancer Prevention and Treatment Act of 2000.  Act 278, Session Laws of Hawaii 2001, also provided state funding for those not eligible for treatment under the federal program.  In addition to this treatment program, it is necessary to provide funding to be used for breast and cervical cancer screening, education, and outreach by the department of health in order to reach more women who are eligible to be screened under the screening program and thereby be eligible to be treated under this treatment program.  In 2008, the legislature authorized transfer of unauthorized treatment funds from the department of human services to the department of health.  However, the transfer was denied by the administration.

     The purpose of this Act is to provide funding for breast and cervical cancer screening, education, and outreach to the department of health to reach more women who are eligible to be screened for breast and cervical cancers.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $150,000 or so much thereof as may be necessary for fiscal year 2009-2010 and the same sum or so much thereof as may be necessary for fiscal year 2010-2011 to the department of health for breast cancer screening, education, and outreach.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2009.
