A BILL FOR AN ACT


 

 

RELATING TO MILITARY RESERVE COMPONENTS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 121, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§121-    Sergeant Deyson Cariaga service members' life insurance reimbursement special fund.  (a)  There is established in the state treasury the Sergeant Deyson Cariaga service members' life insurance reimbursement special fund to be administered by the state department of defense.  The special fund shall consist of legislative appropriations and income from investment of the fund.  Expenditures from the fund shall be made for reimbursing eligible members of the Hawaii national guard and federal military reserves for premiums paid for benefits under the service members' group life insurance program pursuant to 38 U.S.C. Section 1965 et seq., as amended.

     (b)  Eligibility for reimbursement shall be limited to time periods in which the member of the Hawaii army or air national guard, or federal military reserves residing in Hawaii, was deployed on active duty to a combat zone or qualified hazardous duty area as designated under regulations of the United States Department of Defense.

     (c)  The state department of defense shall adopt rules under chapter 91 necessary to implement this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2009.
