Description:

Sunsets the Kaneohe bay regional council.  Designates the Department of land and natural resources as the agency responsible for implementing the council's plans, programs, and policies and requires DLNR to carry out all duties and functions of the council established by chapter 200D, Hawaii Revised Statutes, prior to the effective date of this Act.  (SD1)

A BILL FOR AN ACT


 

 

RELATING TO THE KANEOHE BAY REGIONAL COUNCIL.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 200D, Hawaii Revised Statutes, is repealed.

     SECTION 2.  Notwithstanding the repeal of chapter 200D, Hawaii Revised Statutes, the department of land and natural resources shall continue to exercise full force and effect with respect to all plans, programs, or other policies adopted by the Kaneohe bay regional council prior to the effective date of this Act.

     SECTION 3.  Beginning on the effective date of this Act, the department of land and natural resources shall carry out all of the duties and functions of the Kaneohe bay regional council established by chapter 200D, Hawaii Revised Statutes, prior to the effective date of this Act, which duties shall include facilitating discussions between users of Kaneohe bay and the public, advising the State and the county on matters regarding the use of Kaneohe bay, educating the public and users of Kaneohe bay on the problems and needs of the bay, and implementing and periodically amending the Kaneohe bay master plan as it relates to ocean activities.

     SECTION 4.  This Act shall take effect on July 1, 2009.
