A BILL FOR AN ACT


 

 

relating to department of education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  Keanae school, the last one-room school in the State, closed its doors to its remaining students from kindergarten to third grade in the fall of 2005.  For almost a century since the school opened, the school has served not only as a class room but a community center and rallying place for the residents of Keanae, a small east Maui village comprising of primarily native Hawaiian tied to the land growing taro in ancient loi kalo.

The legislature finds that Keanae school, tax map number (2) 1-1-08: 20, was added to the Hawaii register of historic places on June 2, 1992, as site number 50-07-1630, and the federal register of historic places on June 30, 2000. 

The purpose of this Act is to direct:

     (1)  The department of education to transfer jurisdiction of the Keanae school property and all improvements on the property to the department of land and natural resources; and

     (2)  The department of land and natural resources to work with the Keanae community to develop plans for the future uses of Keanae school so that it may continue to serve the Keanae community.

     SECTION 2.  The department of education is directed to transfer Keanae school, tax map key number (2) 1-1-08: 20, and all improvements thereon, to the department of land and natural resources.

     SECTION 3.  The department of land and natural resources is directed to meet with representatives of the Keanae community to develop plans for the future uses of Keanae school so that it may continue to serve the Keanae community.

     SECTION 4.  All rights, powers, functions, and duties of the department of education relating to the real property to be transferred pursuant to this Act shall be transferred to the department of land and natural resources.

     SECTION 5.  All appropriations, records, equipment, machines, files, supplies, contracts, books, papers, documents, maps, and other personal property heretofore made, used, acquired, or held by the department of education relating to the functions transferred to the department of land and natural resources shall be transferred with the functions to which they relate.

     SECTION 6.  This Act shall take effect upon its approval.
