HOUSE CONCURRENT

RESOLUTION

 

 

requesting the department of land and natural resources to determine whether makapipi stream is BEING SUFFICIENTLY protected in the public interest.

 

 

 


     WHEREAS, the Makapipi stream, located in the Nahiku district on the island of Maui, is a perennial stream that runs from the east Maui mountains to the ocean; and

 

     WHEREAS, the stream provides a majestic view of a waterfall just as it passes under the famed Hana highway; and

 

     WHEREAS, protection of streams is vital to the State during times of flooding and heavy rains to divert and channel water away from homes, buildings, and streets; and

 

     WHEREAS, as part of the east Maui tributary system, Makapipi stream is important for its serene beauty, fresh ground water flow, and the protection if offers from flooding; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2009, the Senate concurring, that the Department of Land and Natural Resources is requested to determine whether Makapipi stream is being sufficiently protected in the public interest; and

 

     BE IT FURTHER RESOLVED that the Department of Land and Natural Resources is requested to include:

 

     (1)  The collection of instream flow and other data, including fishing, wildlife, aesthetic, recreational, water quality, water flow and seasonal changes in flow, other ecological information, and basic streamflow characteristics; and

 

     (2)  The extent and quantity of any diversions of water from the stream;

 

     (3)  An investigation of threatened or endangered beneficial instream uses of water;

 

     (4)  The amount and causes of debris found in the stream, whether naturally or humanly caused, and whether the debris is detrimental to the streamflow;

 

     (5)  Whether an instream flow standard should be adopted for the stream; and

 

     (6)  Recommendation of any other measures that need to be undertaken to ensure the stream is being sufficiently protected in the public interest; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources.
