HOUSE CONCURRENT

RESOLUTION

 

 

requesting the Department of the Attorney General to investigate and assist in the resolution of the issue of ownership of Ulalena Loop Road.

 

 

 


WHEREAS, although Ulalena Loop Road in the county of Maui runs through state land, the State and the county of Maui continue to dispute the ownership of the road; and

 

WHEREAS, the Department of Land and Natural Resources defers to the Department of Transportation regarding the issue of ownership of Ulalena Loop Road; and

 

WHEREAS, the Department of Transportation claims that repair and maintenance of Ulalena Loop Road is the responsibility of the county of Maui; and

 

WHEREAS, the safety of residents of the Haiku district of the county of Maui may be at risk because of the poor condition of Ulalena Loop Road, which desperately needs repaving and maintenance; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2009, the Senate concurring, that the Attorney General is requested to investigate and assist in the resolution of the issue of ownership of Ulalena Loop Road; and

 

     BE IT FURTHER RESOLVED that the Attorney General is requested to submit findings and recommendations, including any necessary proposed legislation to clarify legal jurisdiction over Ulalena Loop Road, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2010; and

 

     BE IT FURTHER RESOLVED that the Department of Transportation is requested to estimate the cost of repaving Ulalena Loop Road and submit the estimate in a report to the Legislature, the Mayor of Maui County, and Chairperson of the Maui County Council no later than twenty days prior to the convening of the Regular Session of 2010; and

 

     BE IT FURTHER RESOLVED that the Department of Transportation is further requested to forward the estimate of the cost of repairing Ualena Loop Road to the public agency identified with the assistance of the Attorney General as having jurisdiction over Ulalena Loop Road no more than thirty days after the Department of Transportation receives the Attorney General's report clarifying which public agency has legal jurisdiction over Ulalena Loop Road; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Attorney General, the Director of Transportation, the Chairperson of the Board of Land and Natural Resources, the Mayor of the County of Maui, and the Chairperson of Maui County Council.
