A BILL FOR AN ACT


 

 

MAKING AN APPROPRIATION TO plan, design, and construct a test well in upcountry Maui to serve as the first phase in the construction of a ground water well to supplement the upcountry MAUI surface water system.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the Maui county water use and development plan indicates that the existing water system cannot accommodate future growth in upcountry Maui and that additional water sources are needed.  The department of land and natural resources supports the development of additional ground water wells on Maui due to the difficulty of developing new surface water diversions.  In addition, increased agricultural demands and regulation of surface water diversions may reduce the amount of surface water available for the county water system.

     The county of Maui drought mitigation strategies of October 2004, indicated that ground water wells could also supplement the surface water supply during drought periods.  The study also indicated that additional fifty to one hundred million gallon lined reservoirs are needed.

     Additional ground water wells could also be incorporated into the county's emergency preparedness plan to provide water in the event of a drought or an unplanned reduction or closure of surface water treatment facilities due to an earthquake or other natural disaster.

     The purpose of this Act is to appropriate funds to plan, design, and construct a test well in upcountry Maui, either in Makawao or Pukalani, to serve as the first phase in the construction of a ground water well to supplement the upcountry surface water system.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $1,800,000 or so much thereof as may be necessary for fiscal year (FY) 2009-2010 and 2010-2011 to plan, design, and construct a test well in upcountry Maui, either in Makawao or Pukalani, to serve as the first phase in the construction of a ground water well to supplement the upcountry surface water system; provided that the sum appropriated shall be allocated as follows:

     Plans and design               $150,000

     Construction                                  $1,650,000

          Total                     $150,000       $1,650,000

     The sums appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2009.
