RELATING TO RECORD CHECKS FOR THE OFFICE OF YOUTH SERVICES. Authorizes the Director of Human Services to conduct child abuse record checks as part of the record checks for all current staff and new staff members of the Hawaii youth correctional facilities.

RELATING TO DOMESTIC VIOLENCE. Allows a tenant who is a victim of domestic violence, sexual abuse, or harassment by stalking to terminate his or her rental agreement.

RELATING TO THE PENAL CODE. Amends the offenses of murder in the first degree, murder in the second degree, assault in the second degree, and terroristic threatening in the first degree to include conduct committed against victims who the courts and police are attempting to keep safe with protective orders.

RELATING TO MANDATORY REPORTING OF CHILD ABUSE AND NEGLECT. Broadens the group of persons required to report child abuse and neglect to include family members, unless they are victims of domestic violence.

RELATING TO FAMILY COURT. Increases the maximum term of a temporary guardianship of a minor from six months to twelve months.

RELATING TO CHILD CARE. Creates penalties for child care facility providers who misrepresent material information about their child care center operations to the guardians or parents of a prospective or active child at the center, an employee of the department of human services, or any law enforcement officer.

RELATING TO CHILDREN. Permits the special court trustee to recommend that $100 be assessed against a parent who interferes with visitation by failing to keep a scheduled visit without timely notifying the other parent of cancelation or by failing to reschedule a canceled visit within a reasonable time.

RELATING TO SERVICE OF COURT ORDERS. Allows a court to order substituted service of protective and temporary restraining orders if the court finds that the respondent has been deliberately avoiding personal service.

RELATING TO PROTECTIVE ORDERS. Requires periodic court review of protective order where duration of initial or extended order exceeds 3 years.

RELATING TO CHILD WELFARE SERVICES. Adds definitions of "caregiver" and "safe home" to the Child Protective Act. Clarifies that local customs of caring for children outside the family home by relatives and friends are, where appropriate, available alternatives to the department of human services and the court assuming custody of children.

RELATING TO THE PENAL CODE. To provide greater protections to victims of domestic violence who the court is already attempting to keep safe through protective orders.

RELATING TO PERSONS COMMITTED TO THE HAWAII YOUTH CORRECTIONAL FACILITIES OR TO THE CUSTODY OR CARE OF THE EXECUTIVE DIRECTOR OF THE OFFICE OF YOUTH SERVICES. Allows the Hawaii Youth Correctional Facility to obtain necessary information on youth committed to the facility quickly when the youth are admitted, and to use the information for treatment and care within the facility.

RELATING TO NOTICE OF GUARDIANSHIP PROCEEDINGS. Amends section 560:5-113, Hawaii Revised Statutes, to provide that notice to parents shall not be required if the parents have been served in a proceeding under chapter 587, Hawaii Revised Statutes, and a permanent plan has been ordered by the Court.

RELATING TO INVESTIGATORS OF THE DEPARTMENT OF HUMAN SERVICES. Authorizes the Director of Human Services to appoint and commission investigators to investigate incidents at the Hawaii youth correctional facilities, and gives these investigators access to necessary information maintained by state and county entities.

RELATING TO CRIMINAL CONTEMPT OF COURT. Prohibits a court from imprisoning a victim of a sexual assault or domestic abuse crime for contempt for refusing to testify concerning that sexual assault or domestic abuse crime.

RELATING TO INCOME TAX. Allows a taxpayer to choose between the current $5 or a new $8 check off donation from their tax liability for the Hawaii children's trust fund, and the domestic violence and sexual assault special funds within the department of health, the department of human services, and the judiciary.

RELATING TO INDIVIDUAL DEVELOPMENT ACCOUNTS. Clarifies guidelines for individual development accounts (IDAs) and designates the department of human services or a contracted agency to administer IDAs. Appropriates funds.

MAKING AN APPROPRIATION FOR EMERGENCY DOMESTIC VIOLENCE SHELTERS. Makes an appropriation for emergency domestic violence shelters.

DECISION MAKING TO FOLLOW
Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:
· Testifier's name with position/title and organization;
· The Committee the comments are directed to;
· The date and time of the hearing;
· Measure number; and
· The number of copies the Committee is requesting.
While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.
