A BILL FOR AN ACT


 

 

RELATING TO HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  According to the Centers for Disease Control and Prevention, two-thirds of adults in the United States are overweight or obese.  The rate of obesity has tripled among children and teens since 1980.  Obesity increases the risk of diabetes, heart disease, stroke, and other health problems and costs families, businesses, and governments millions of dollars each year.

     Research continues to reveal a strong link between diet and health.  Increased calorie intake is a key contributor to the alarming increase in obesity.  Excess saturated fat intake is a major risk factor for heart disease.  Increased sodium intake is associated with an increased risk of high blood pressure or hypertension, a condition that can lead to cardiovascular problems and stroke.

     There is an upward trend in calorie and sodium intake that coincides with a significant increase in the number of meals prepared and eaten outside the home in the past two decades.  It is estimated that half of the money consumers spend on food goes toward food from restaurants and other food service establishments, which is also where one-third of their calories are consumed.

     The legislature finds that improving the availability of nutritional information about food from food service establishments will help curb unhealthy food consumption.  Three-quarters of American adults report using the information found on nutritional labels required by the federal Nutrition Labeling and Education Act of 1990, but while nutrition labeling is currently required on most packaged foods, labeling for restaurant foods is only required when nutrient content or health claims are made.  Given the lack of nutritional information for most restaurant foods, it is difficult for restaurant-goers to make decisions that limit their calorie and sodium intake.

     The purpose of this Act, which shall be known as the "Menu Education and Labeling Act," is to require a franchise retail food establishment to maintain nutritional information on each of its standard menu items and have that information readily available to provide to the public upon request.

     SECTION 2.  Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§321-     Franchise retail food establishments; nutritional information.  (a)  From January 1, 2012, a franchise retail food establishment shall maintain nutritional information on each standard menu item on the menu and provide this nutritional information to customers; provided that:

     (1)  If the franchise retail food establishment does not provide sit-down service, the franchise retail food establishment shall disclose the information in a clear and conspicuous manner in a brochure or booklet that is made available at the point of sale prior to or during the placement of an order;

     (2)  If the franchise retail food establishment provides sit-down service, the franchise retail food establishment shall provide the nutritional information in a clear and conspicuous size and typeface in at least one of the following:

          (A)  A brochure available on the table;

          (B)  A menu next to each standard menu item;

          (C)  A menu, under an index section that is separate      from the listing of standard menu items;

          (D)  A menu insert; or

          (E)  A table tent on the table;

     (3)  If the franchise retail food establishment serves a standard menu item in a self-serve capacity, such as in a salad bar, buffet line, or cafeteria service, it may limit the nutritional information maintained and provided to the total number of calories per standard serving per item; and

     (4)  If the franchise retail food establishment has a drive-through, for purposes of the drive-through area only, nutritional information shall be provided upon customer request; provided further that a notice shall be clearly and conspicuously displayed at the point of sale that reads:  "Nutrition information is available upon request."

     (b)  From January 1, 2012, a franchise retail food establishment that provides a menu shall disclose calorie content information for a standard menu item next to the item on the menu in a size and typeface that is clear and conspicuous.

     (c)  From January 1, 2012, a franchise retail food establishment that uses an indoor menu board shall disclose calorie content information for a standard menu item next to the item on the menu board in a size and typeface that is clear and conspicuous.

     (d)  From January 1, 2012, every franchise retail food establishment that uses a display tag as an alternative to a menu or menu board to describe a standard menu item that is displayed for sale in a display case within the franchise retail food establishment shall disclose calorie content information for that standard menu item on the display tag for that item in a size and typeface that is clear and conspicuous.

     (e)  For purposes of subsections (b), (c), and (d), the disclosure of calorie content information on a menu, menu board, or display tag next to a standard menu item that is a combination of at least two standard menu items on the menu or menu board, shall, based upon all possible combinations for that standard menu item, include both the minimum amount of calories for the calorie count information and the maximum amount of calories for the calorie count information.  If there is only one possible total amount of calories, then this total shall be disclosed.

     (f)  For purposes of subsections (b), (c), and (d), the disclosure of calorie content information on a menu, menu board, or display tag next to a standard menu item that is not an appetizer or dessert, but is intended to serve more than one individual, shall include the following:

     (1)  The number of individuals intended to be served by the standard menu item; and

     (2)  The calorie content information per individual serving.

     (g)  The nutritional information and calorie content information required by this section shall be determined on a reasonable basis.  A reasonable basis determination of nutritional and calorie content information shall be required only once per standard menu item; provided that portion size is reasonably consistent and the franchise retail food establishment follows a standardized recipe and trains to a consistent method of preparation.

     (h)  Menus and menu boards may include a disclaimer that indicates that there may be variations in nutritional content across servings based on variations in overall size and quantities of ingredients, and based on special ordering.

     (i)  This section shall not be construed to create or enhance any claim, right of action, or civil liability that did not previously exist under state law or limit any claim, right of action, or civil liability that otherwise exists under state law.  No private right of action shall arise out of this section.

     (j)  This section shall not be construed to preclude any franchise retail food establishment from voluntarily providing nutritional information in addition to the requirements of this section.

     (k)  To the extent consistent with federal law, no county shall enact any ordinance or adopt any rule on any matters covered by this section, including the disclosure of nutritional information and content required to be posted on menus, menu boards, and food tags by a franchise retail food establishment.  Any county ordinance or rule that violates this prohibition is void and shall have no force or effect.

     (l)  A franchise retail food establishment that violates this section shall be punishable by a fine of not less than $50 or more than $500, which may be assessed by the department of health.  A franchise retail food establishment shall not be found to violate this section more than once during an inspection visit.

     (m)  The department of health shall enforce this section.  The director of health shall adopt rules pursuant to chapter 91 to implement this section.

     (n)  This section shall not apply to:

     (1)  Farmers' markets;

     (2)  Commissaries;

     (3)  Health care facilities as defined in section 323D-2 and licensed by the department of health;

     (4)  Mobile support units;

     (5)  Restricted food service facilities;

     (6)  Retail stores in which a majority of sales are from a pharmacy, as defined in section 461-1; and

     (7)  Vending machines.

     (o)  For the purposes of this section:

     "Appetizer" means a food item that is generally served prior to a food item that is generally regarded as the primary food item in a meal or identified as an appetizer on the menu, menu board, or display tag.  An "appetizer" includes a first course, starter, or small plate.

     "Calorie content information" means the total number of calories per standard menu item, as that item is usually prepared and offered for sale.

     "Dessert" means a food item that is generally served after a food item that is generally regarded as the primary food item in a meal or identified as a dessert on the menu, menu board, or display tag.  "Dessert" includes cakes, pastries, pies, ice cream, and food items that contain ice cream, confections, and other sweets.

     "Drive-through" means an area where a customer may provide an order for and receive standard menu items while occupying a motor vehicle.

     "Franchise retail food establishment" means a retail food establishment that is owned, controlled, or franchised by an entity whose business includes the franchising of retail food establishments under one or more franchise brands or trade names in at least fifteen states in the United States, regardless of the ownership of the individual establishments.

     "Menu board" means a posted list or pictorial display of standard menu items offered for sale by a franchise retail food establishment.  "Menu board" does not include printed or pictorial materials for the purpose of marketing.

     "Nutritional information" means information that includes the number of:

     (1)  Calories;

     (2)  Grams of saturated fat;

     (3)  Grams of carbohydrates; and

     (4)  Milligrams of sodium.

     "Reasonable basis" means any reasonable means recognized by the federal Food and Drug Administration of determining nutritional information, and calorie content information for a standard menu item, as usually prepared and offered for sale, including nutrient databases and laboratory analyses.

     "Standard menu items" means food offered for sale that appears on the menu, menu board, or display tag for more than one hundred eighty days per year, except for condiments, customized orders, packaged food otherwise subject to the nutrition labeling requirements of the federal Nutrition Labeling and Education Act of 1990, items placed on counters or tables for use without charge to customers, and daily specials."

     SECTION 3.  If any provision of this section or the application thereof is for any reason held invalid, ineffective, or unconstitutional by a court of competent jurisdiction, the remainder of this section shall not be affected thereby, and to this end, the provisions of this section are severable.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2020.
