A BILL FOR AN ACT

 

 

relating to parks.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Hawaii faces an uncertain economic outlook.  The seriousness of the economic contraction that the State is experiencing compels a consideration of changes that will allow a better deployment of state and county resources.  The legislature also finds that the county of Hawaii is willing to take over the operation, maintenance, and improvement of certain parks on the island of Hawaii in order to relieve the State of the burden of those parks in the face of current financial difficulties.

     The purpose of this Act is to provide for the transfer of certain state parks to the county of Hawaii in order to better utilize the resources of each jurisdiction.

     SECTION 2.  (a)  On January 1, 2011, subject to a prior written agreement between the governor and the mayor of the county of Hawaii, the governor may transfer the estate, title, right, interest, and any appurtenance of the Mauna Kea and Hapuna beach state recreational areas to the county of Hawaii.

     (b)  All appropriations, except appropriations for personnel, records, files, supplies, contracts, books, papers, documents, maps, and other property made, used, acquired, or held by the department of land and natural resources regarding the land and appurtenances of the Mauna Kea and Hapuna beach state recreational areas shall be transferred with those lands and appurtenances on January 1, 2011, under the direction of the governor.

     (c)  No personnel or equipment shall be included in the transfer authorized by subsection (a).

     SECTION 3.  The costs associated with the transfer of any records, equipment, and other personal property regarding the Mauna Kea and Hapuna beach state recreational areas, and all other costs associated with effectuating the purposes of this Act shall be borne by the State.

     SECTION 4.  It is the intent of this Act not to jeopardize the receipt of any federal funds or impair the obligation of the State or agency thereof to the holders of any bond issued by the State or by any agency.  The governor may modify the provisions of this Act necessary to effectuate this intent; provided that the governor shall report any modifications and the reasons for the modifications to the legislature no later than twenty days prior to the 2012 regular session.

     SECTION 5.  This Act shall take effect upon its approval.
