A BILL FOR AN ACT

 

 

relating to procurement.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 103D-301, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§103D-301[]]  Methods of source selection[.]; contract requirements.  (a)  Unless otherwise authorized by law, all contracts shall be awarded by competitive sealed bidding pursuant to section 103D-302, except as provided in:

     (1)  Section 103D-303 (Competitive sealed proposals);

     (2)  Section 103D-304 (Professional services procurement);

     (3)  Section 103D-305 (Small purchases);

     (4)  Section 103D-306 (Sole source procurement); and

     (5)  Section 103D-307 (Emergency procurements).

     (b)  Notwithstanding any other law, rule, or practice to the contrary, for purposes of this chapter:

     (1)  A contract shall be deemed effective as of the notice of the award;

     (2)  The solicitation, offer, bid, or proposal and the notice of award shall constitute the entire contract and agreement between the governmental body and the contractor; and

     (3)  A subsequent written and executed contract document shall not be required."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Description:

Amends the Hawaii public procurement code to make public contracts effective as of the notice of the award.  Specifies that the solicitation, offer, bid, or proposal and the award notice constitute the entire contract.  Provides that a subsequent written and executed contract is not required.
