A BILL FOR AN ACT

 

 

RELATING TO NET ZERO ENERGY BUILDING PERMITTING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Net zero energy buildings are designed to consume net zero energy use and produce zero carbon emissions.  Currently, permits for net zero energy buildings are processed in the same manner as for other buildings.  However, unlike other buildings, net zero energy buildings promote the growth of energy efficiency and renewable energy in the State.  Therefore, expediting the permitting process for net zero energy buildings would be a no-cost incentive for increasing the design and construction of energy-efficient buildings in Hawaii.

     SECTION 2.  Chapter 107, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§107-    Net zero energy building design.  Not later than January 1, 2012, the council shall adopt rules implementing a prescriptive design alternative for net zero energy buildings that is equivalent to thirty-five per cent more energy efficient than the 2006 International Energy Conservation Code, as published by the International Code Council.

     As used in this section, "net zero energy building" has the same meaning as defined in section 196-2."

     SECTION 3.  Section 46-15.6, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

     ""Net zero energy building" has the same meaning as defined in section 196-2."

     SECTION 4.  Section 46-19.4, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§46-19.4  Priority permitting process for renewable energy and net zero energy building projects.[]]  All agencies shall provide priority handling and processing for all county permits required for renewable energy and net zero energy building projects.

     For purposes of this section, "agencies" means any executive department, independent commission, board, bureau, office, or other establishment of a county, or any quasi-public institution that is supported in whole or in part by county funds."

     SECTION 5.  Section 196-1.5, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§196-1.5  Priority permitting process for renewable energy and net zero energy building projects.[]]  All agencies shall provide priority handling and processing for all state permits required for renewable energy and net zero energy building projects.

     For purposes of this section, "agencies" means any executive department, independent commission, board, bureau, office, or other establishment of the State, or any quasi-public institution that is supported in whole or in part by state  funds."

     SECTION 6.  Section 196-2, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

     ""Net zero energy building" means a residential or commercial building that is thirty-five per cent more energy efficient than required under the 2006 International Energy Conservation Code, as published by the International Code Council.  This efficiency may be met by either performance-based or prescriptive-based design."

     SECTION 7.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 8.  This Act shall take effect upon its approval.
