A BILL FOR AN ACT

 

 

relating to kamilo nui valley.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature recognizes that since the 1970's, Kamilo Nui valley has provided a safe haven from the rapid urban growth of east Honolulu.  Kamilo Nui valley is the largest and last parcel of undeveloped land in east Honolulu and the only remaining agricultural lands in the area.

     The farmers of Kamilo Nui valley have been farming for almost thirty-five years, raising a variety of agricultural products including vegetables to plants.  These farmers have taken an active role in the State's sustainable future.

     The legislature finds that Kamilo Nui valley contributes to the preservation of Hawaii's environment and is an important agricultural resource.

     The purpose of this Act is to preserve Kamilo Nui valley in agricultural use in order to maintain Hawaii's farming livelihood, provide sustainable food sources for the State, and protect Hawaii's environment.

     SECTION 2.  Chapter 205, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§205-    Kamilo Nui valley; agricultural designation.  (a)  Notwithstanding any law to the contrary, the land use classification of the Kamilo Nui valley farm lands shall be changed from urban to agricultural.

     (b)  For the purposes of this section, "Kamilo Nui valley" means the usable farm land in east Honolulu bounded by Hawaii Kai drive, Kaiwi road, and the mountain side along Kaluanui road."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
