RELATING TO PUBLIC PROCUREMENT.

Amends various sections of the Hawaii Public Procurement Code, Chapter 103D, Hawaii Revised Statutes, to simplify and streamline procurement processes to enable agencies to expeditiously acquire the resources or services they need to perform their missions.

RELATING TO PROCUREMENT.

Amends the Hawaii public procurement code to set time limits or awards in the request for proposal process, make public contracts effective as of the notice of the award, specify that the solicitation, offer, bid, or proposal and the award notice constitute the entire contract, and provide that a subsequent written and executed contract is not required.  Requires the State Procurement Office to authorize reseller agreements in multi-state contracting agreements.  Requires the Procurement Policy Board to adopt rules to promote Hawaii businesses.

RELATING TO PROCUREMENT.

Requires contracts awarded to projects of the departments of Hawaiian home lands and transportation; county boards of water supply; and county departments of housing, planning and permitting, and transportation to be awarded within 30 days of the bid opening date, subject to sufficient available funding and possible further negotiations to benefit the public.  Requires contracts by these agencies for design professional services to be awarded within 45 days of the bid opening date.

RELATING TO PROCUREMENT.

Establishes discretionary request for competitive sealed proposal procedure using the design-build process where not more than five offerors selected on their qualifications submit proposals, and stipends are paid to unsuccessful offerors who allow the agency to use elements of their designs and waive their right to protest the award.

Authorizes the natural energy laboratory of Hawaii authority to enter into concessions for cell towers.

RELATING TO THE NATURAL ENERGY LABORATORY OF HAWAII AUTHORITY.

Authorizes the Natural Energy Laboratory of Hawaii Authority (NELHA) to acquire, hold, and sell qualified securities subject to certain conditions.  Authorizes NELHA to accept donations of money, property, and services.  Effective January 1, 2112.

RELATING TO THE HAWAII TOURISM AUTHORITY.

Authorizes the Hawaii Tourism Authority to maintain the confidentiality of competitively sensitive information.  Preserves certain autonomy provisions of Act 58, SLH 2004. Requires quarterly reports.  Effective January 1, 2112.

RELATING TO HAWAII TELEVISION AND FILM DEVELOPMENT.

Transfers the television and film industry activities and responsibilities under the Department of Business, Economic Development, and Tourism to the Hawaii Tourism Authority.  Effective July 1, 2112.

DECISION MAKING TO FOLLOW

 

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing with a transmittal cover indicating:

·     Testifier's name with position/title and organization;

·     The Committee the comments are directed to;

·     The date and time of the hearing;

·     Measure number; and

·     The number of copies the Committee is requesting. 

 

While every effort will be made to copy, organize, and collate all testimony received, materials received on the day of the hearing or improperly identified or directed to the incorrect office, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
