HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING THE AUDITOR TO CONDUCT A SUNRISE REVIEW TO DETERMINE WHETHER large scale dog breeders SHOULD BE licensed BY THE DEPARTMENT OF COMMERCE AND CONSUMER AFFAIRS.

 

 

 


     WHEREAS, the large scale breeding of dogs is often conducted under conditions that inflict long-term suffering on the dogs; and

 

     WHEREAS, the large scale breeding of dogs may lead to the sale of unhealthy dogs to unsuspecting consumers; and

 

     WHEREAS, the State currently does not regulate the breeding of dogs; and

 

     WHEREAS, establishing a licensing requirement for large scale dog breeders would help prevent cruelty to dogs and protect consumers; and

 

     WHEREAS, a breeder license would provide, at minimum, for inspection of the breeding facility to ensure adequacy and cleanliness, a process for investigation, and the payment of licensing fees; and

 

     WHEREAS, H.B. No. 1621, introduced during the Regular Session of 2011, requires that, in order to operate a large scale dog breeding operation, a person shall possess a valid dog breeder license issued by the Department of Commerce and Consumer Affairs; and

 

     WHEREAS, under section 26H-6, Hawaii Revised Statutes, measures that would subject unregulated professions and occupations to licensing or other regulatory controls cannot be enacted unless the Auditor has conducted a sunrise review of the specific measure identified through a concurrent resolution; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, the Senate concurring, that the Auditor is requested to perform a sunrise review of the regulation of large scale dog breeders by the Department of Commerce and Consumer Affairs as contemplated under H.B. No. 1621, introduced during the Regular Session of 2011; and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to submit to the Legislature a report on any findings and recommendations, including proposed legislation, not later than twenty days prior to the convening of the Regular Session of 2012; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and Director of Commerce and Consumer Affairs.
