HOUSE RESOLUTION

 

 

requesting the hawaii advisory commission on drug abuse and controlled substances to determine whether bath salts, ALSO KNOWN AS mephedrone and methylenedioxypyrovalerone, should be designated as a controlled substance.

 

 

 


     WHEREAS, the Hawaii Advisory Commission on Drug Abuse and Controlled Substances, which is established under the Department of Health for administrative purposes, is charged with the responsibility of acting in an advisory capacity to the Department of Public Safety relating to the scheduling of controlled substances, by recommending the addition, deletion, or rescheduling of all substances designated as controlled substances under the Uniform Controlled Substances Act; and

 

     WHEREAS, the Department of Public Safety is charged with the responsibility of submitting annual reports to the Legislature, three months prior to the convening of each regular session, with regard to additions, deletions, or revisions to the schedules of controlled substances under the Uniform Controlled Substances Act; and

 

     WHEREAS, bath salts, or mephedrone and methylenedioxypyrovalerone, also known as MDPV, are currently not designated as controlled substances under any of the five schedules of controlled substances under the Uniform Controlled Substances Act; and

 

     WHEREAS, bath salts are a synthetic designer drug, and they are a stimulant; and

 

     WHEREAS, bath salts are usually snorted or smoked, not unlike cocaine or methamphetamine, and produce a high similar to methamphetamines and sometimes violent behavior in users; and

 

     WHEREAS, bath salts may cause hallucinations, paranoia, a rapid heart rate, and suicidal thoughts; and

 

WHEREAS, the White House Drug Czar Gil Kerlikowske issued a written statement in February 2011, warning people about the dangers of taking bath salts; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, that the Hawaii Advisory Commission on Drug Abuse and Controlled Substances is requested to determine whether bath salts, also known as mephedrone and methylenedioxypyrovalerone, should be designated as a controlled substance; and

 

     BE IT FURTHER RESOLVED that the Department of Public Safety is requested to include in its mandatory annual report to the Legislature its recommendation on whether bath salts, also known as mephedrone and methylenedioxypyrovalerone, should be added to any of the schedules of substances under the Uniform Controlled Substances Act; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Director of Public Safety and the Chairperson of the Hawaii Advisory Commission on Drug Abuse and Controlled Substances.
