Reduces the appointed membership of the environmental council from 15 to 9.  Clarifies the duties of the OEQC, director, and environmental council.

RELATING TO THE OFFICE OF ENVIRONMENTAL QUALITY CONTROL.

Establishes filing fees to help fund operations of the OEQC.  Creates special fund.

RELATING TO ENVIRONMENTAL IMPACT STATEMENTS.

Extends the sunset date of Act 87, Session Laws of Hawaii, from July 1, 2011 to July 1, 2015; Act 87 excepts from the environmental impact statement law, certain primary actions not subject to discretionary consent and involving ancillary secondary actions limited to infrastructure in public rights-of-way or exempt highways.

Applies the solid waste disposal surcharge to waste that is deposited in landfills, incinerators, or waste-to-energy facilities, whether the waste is disposed of in-state or transferred out-of-state.

RELATING TO THE EMERGENCY ENVIRONMENTAL WORKFORCE.

Appropriates funds for the establishment of an emergency environmental workforce program in light of recent national and local economic downturns and wars; provides for the continuation of emergency environmental workforce services during periods of warfare or significant economic hardship.

        Status

PROPOSING AN AMENDMENT TO ARTICLE XI, SECTION 9, OF THE CONSTITUTION OF THE STATE OF HAWAII TO REAFFIRM AND STRENGTHEN THE STATE'S COMMITMENT TO ENVIRONMENTAL RIGHTS.

Proposes an amendment to article XI, section 9, of the Constitution of the State of Hawaii to reaffirm and strengthen the State's commitment to environmental justice for certain populations that are disproportionately impacted by harmful environmental actions.

·         In person:  1 copy of their testimony to the committee clerk, Room 201, State Capitol.

 

·         By fax:  Testimony may be faxed if less than 5 pages in length, to the Senate Sergeant-At-Arms Office at 586-6659 or 1-800-586-6659 (toll free for neighbor islands), at least 24 hours prior to the hearing.  When faxing, please indicate to which committee the testimony is being submitted and the date and time of the hearing.

 

Please note:  If you submit your written testimony after 4:00 p.m. the day prior to the hearing, please sign-in at the staff table to testify orally.  A copy of your testimony may not be available during the hearing but will be posted online for the public after the hearing. 

 

If you require special assistance or auxiliary aids or services to participate in the public hearing process (i.e., sign or foreign language interpreter or wheelchair accessibility), please contact the committee clerk 24 hours prior to the hearing so arrangements can be made.
