Establishes the weed and seed strategy under the department of labor and industrial relations.  Makes appropriation.

RELATING TO THE WEED AND SEED STRATEGY.

Establishes a permanent weed and seed program within DLIR.  Appropriates funds as a grant to maintain the operations of the weed and seed program in the Ala Moana, Chinatown, downtown Honolulu, Kalihi, Waipahu, and Ewa beach communities on Oahu.

RELATING TO PUBLIC WORK PROJECTS.

Clarifies that a single violation of the prevailing wage law refers to each separate project where the department of labor and industrial relations finds a contractor in violation.

RELATING TO UNEMPLOYMENT INSURANCE.

Makes fear of domestic or sexual violence a good cause for not accepting otherwise suitable, available work.  Effective July 1, 2050. (HB574 HD1)

RELATING TO WORKERS' COMPENSATION.

Requires independent medical examinations and permanent impairment rating examinations for workers' compensation claims to be performed by physicians mutually agreed upon by employers and employees or appointed by the DLIR director. (pending re-referral)

Status

PROPOSING AN AMENDMENT TO ARTICLE VII, SECTION 6, OF THE HAWAII CONSTITUTION, RELATING TO THE DISPOSITION OF EXCESS REVENUES.

Proposes a constitutional amendment to article VII, section 6 of the state constitution to authorize the legislature to deposit excess general fund revenues into a fund to fund pension benefits and other post-employment benefits for State employees.

RELATING TO FEDERAL TAX QUALIFICATION REQUIREMENTS FOR THE EMPLOYEES' RETIREMENT SYSTEM.

Adopts language, regarding death benefits for Employees' Retirement System member on qualified military service, required to maintain the tax-qualified status of the Employees' Retirement System and adopts provisions, for the commencement of benefits, required to maintain the tax qualified status of the Employees' Retirement System.

RELATING TO EMPLOYER CONTRIBUTIONS TO THE EMPLOYEES' RETIREMENT SYSTEM.

Sets the rates for employer contributions to the Employees' Retirement System.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

Provides for retirement benefits for State and county employees who become members of the Employees' Retirement System after June 30, 2012.

Provides for the retirement age for state and county employees who become members of the ERS after 6/30/12.

RELATING TO THE EMPLOYEES' RETIREMENT SYSTEM.

Reduces the investment return yield rate assumption for ERS for the fiscal year ending 06/30/11, to 7 3/4%.  Authorizes the ERS board of trustees to set the investment return yield rate assumption after 06/30/11, based on recommendations of the actuary.

Testimony submitted will be placed on the Legislative Web site after the hearing adjourns.  This public posting of testimony on the Web site should be considered when including personal information in your testimony.
