A BILL FOR AN ACT

 

 

RELATING TO HUMAN SERVICES AND HEALTH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  According to the executive office on aging, the elderly population in Hawaii is one of the fastest growing in the country.  Between 1990 and 2000, the number of persons aged sixty and older increased by nineteen per cent, compared to a nationwide increase of nine per cent.  Studies conducted by the executive office on aging and the four county area agencies on aging have indicated that the elderly in Hawaii have a significant need for assistance in various areas and this need is outpacing the ability to provide assistance.  Significant issues that arise with elderly people include health status, changes in family structure (caregivers), social security stability for the future, fear of health care burdens (financial stability), and changes in public responsibility.  Case management and needs assessments of older adults are required to mold programs and services to meet the needs of the elderly community.  As Hawaii's culture and values revolve around family, most caregiving of the elderly in Hawaii is provided by family members, which poses financial hardships for these family members.  Financial stability and burden are the main issues for the elderly and their caregivers and families.  Long-term care services are expensive and the high cost for services may lead to changes in living arrangements and family households, especially in Hawaii.

     The kupuna care program was established in 1999 as a collaborative effort by several agencies in Hawaii to address the needs of the elderly population and the issues arising from those needs.  The program is home- and community-based, designed to address the increased need for affordable long-term care and the desire to remain in the community.  Kupuna care is considered to be an alternative to the traditional long-term care options, which include hospitals, nursing homes, adult residential care homes, adult foster homes, hospice, senior housing, public guardianship, and other programs administered by other state offices.  The goal of kupuna care is to give Hawaii's elderly population access to affordable and quality home- and community-based services that are client-centered and family-supportive, allowing the elderly to live with independence and dignity.  The ten core services that are offered, which are a reflection of the greatest need, are:

     (1)  Adult day care;

     (2)  Attendant care;

     (3)  Case management;

     (4)  Chore;

     (5)  Homemaker;

     (6)  Personal care;

     (7)  Assisted transportation;

     (8)  Kupuna care transportation;

     (9)  Home delivered meals; and

    (10)  Meals for the elderly.

     In 2008, thousands of elderly people were served by kupuna care.  According to the state program report for fiscal year 2008 as prepared by the executive office on aging, 3,277 elders received meals delivered to their homes, 1,744 elders were served by case managers, 874 elders used personal care, and 597 elders used the homemaker services.  Kupuna care fills an important gap in assistance for the elderly in Hawaii and cuts in service would be detrimental to their ability to live with independence and dignity.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 and the same sum or so much thereof as may be necessary for fiscal year 2012-2013 to provide additional funding for the kupuna care program.  This funding shall be in addition to the $          executive office on aging base budget.

     The sums appropriated shall be expended by the department of health for the purposes of this part.

PART II

     SECTION 3.  The legislature finds that the national and global economic crisis that began in the second half of 2008 has caused significant economic problems in numerous industries in the State, including the airline, cruise ship, tourist, and construction industries.  Mass layoffs have been reported by an increasing number of Hawaii businesses statewide, from the agricultural sector to the medical-services sector.  Difficult economic times and declining tax revenues have resulted in budget cuts for all state services.

     The current and impending situation jeopardizes the safety net of basic human services, health, and education needs for Hawaii's residents and families.  While all of Hawaii's residents will be affected by the situation, gap group families and families closest to the poverty line will suffer the most.

     Pursuant to Act 304, Session Laws of Hawaii 1999, the legislature established the emergency and budget reserve fund, which is codified in section 328L-3, Hawaii Revised Statutes, as a temporary supplemental source of funding for the State of Hawaii in times of emergency, economic downturn, or unforeseen reduction in revenues.  As set forth in section 328L-3, Hawaii Revised Statutes, specific purposes for the fund include maintaining levels of programs determined to be essential to public health, safety, welfare, and education.  Section 328L-3, Hawaii Revised Statutes, also includes certain prohibitions on appropriations from the emergency and budget reserve fund.  Appropriations for the following purposes are specifically prohibited:

     (1)  To meet expenses of the legislature;

     (2)  To provide for salary adjustments for officials appointed pursuant to article V, section 6 or article VI, section 3, of the Hawaii State Constitution and for others whose salaries are directly related to salaries of these officials; and

     (3)  To fund cost items in any collective bargaining contract.

     The legislature finds that expenditures from the emergency and budget reserve fund are needed to meet the conditions of emergency, economic downturn, and unforeseen reduction in revenues that the State currently faces.  Further, the legislature finds that the appropriations in this part are consistent with the purposes of the emergency and budget reserve fund.

     The purpose of this part is to appropriate moneys from the emergency and budget reserve fund of the State of Hawaii to maintain the levels of programs determined to be essential to education, public health, and public welfare.

     SECTION 4.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 for respite services.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 5.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 to supplement the healthy start program.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 6.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Waikiki community center.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 7.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 for the kupuna care program.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 8.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 for the aging and disability resource center.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 9.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 for the developmental disabilities medicaid waiver program.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 10.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 for mental health services.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 11.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 for the partnerships in community living program.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 12.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 for substance abuse treatment.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 13.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 for the healthy aging partnerships program.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 14.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Waianae District Comprehensive Health and Hospital Board, Inc., to support its emergency room services.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 15.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, for HIV/AIDS related services and to be distributed as follows:

     (1)  Life Foundation                                $

     (2)  Gregory House Programs                         $

     (3)  Community Health Outreach Work

Project to Prevent AIDS                        $

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 16.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 to fund the housing first pilot program, through a collaboration between the Hawaii public housing authority and the department of human services, for chronically homeless individuals, including those who have an addiction or mental illness, or both.

     The Hawaii public housing authority, in collaboration with the department of human services shall prepare a report to the legislature on the progress of the housing first pilot program.  The Hawaii public housing authority shall submit the report to the legislature no later than twenty days prior to the convening of the regular session of 2012.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 17.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 for meals for the elderly for kupuna care.

     The sum appropriated shall be expended by the department of health's executive office on aging for the purposes of this part.

     SECTION 18.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Kokua Kalihi Valley (Comprehensive Family Services).

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 19.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to The PATH Clinic for services to pregnant women struggling with addiction.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 20.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 for the baby S.A.F.E. (substance abuse free environment) program.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 21.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 for fetal alcohol spectrum disorders.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 22.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 for family planning.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 23.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 for perinatal health programs.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 24.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 for the preschool developmental screening program.

     The sum appropriated shall be expended by the department of health for the purposes of this part.

     SECTION 25.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Blueprint for Change for neighborhood place walk-in centers.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 26.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Primary Care Association for the Hawaii immigrant health initiative program provided at federally qualified health centers.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 27.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to support domestic violence shelters statewide and to be distributed as follows:

     (1)  Child and Family Service                       

          (A)  Two shelters on Oahu                      $

          (B)  Two shelters on Big Island                $

     (2)  Parents and Children Together                  $

     (3)  Women Helping Women                            $

     (4)  Molokai Community Service Council, Inc.        $

     (5)  Young Women's Christian

          Association (YWCA) of Kauai                    $

     (6)  Windward Spouse Abuse Shelter                  $

     (7)  Statewide domestic violence shelters           $

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 28.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Hale Mahaolu for personal care services.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 29.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 for the shelter plus care program.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 30.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Hawaii Primary Care Association for health care services for uninsured persons.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 31.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Primary Care Association for adult dental care provided at federally qualified health centers; provided that the funds shall not be used for any other purpose.  The governor is authorized to utilize enhanced federal medical assistance percentages funds to offset the amount appropriated; provided that the total amount shall not exceed $          .  The department of human services shall prepare a report on:

     (1)  The number of adults receiving these benefits;

     (2)  The cost per person;

     (3)  Total breakdown of administrative costs and other overhead costs; and

     (4)  Statistics, if available, on how this dental program is reducing the number of emergency dental-related medical procedures;

provided further that the department of human services shall submit its report to the legislature no later than twenty days prior to the convening of the 2012 regular session.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 32.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2011-2012 for the Maui community college, University of Hawaii, for the adult dental care program.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 33.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Primary Care Association for outstationed eligibility worker services provided at federally qualified health centers.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 34.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Primary Care Association for outreach services provided at federally qualified health centers.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 35.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Primary Care Association for outreach services to locate uninsured children provided at federally qualified health centers.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 36.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2011-2012 for child care subsidies.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 37.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2011-2012 for the general assistance to households without minor dependents program under section 346-71, Hawaii Revised Statutes, to maintain the general assistance benefit amount at $450 per person per month or as close to $450 per person per month as possible, given the monthly caseload.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 38.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Adult Friends for Youth for youth gang prevention and intervention services.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 39.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Hawaii Centers for Independent Living for statewide independent living services.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 40.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Susannah Wesley Community Center for the Susannah Wesley Community Center Youth Service Center.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 41.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Planned Parenthood of Hawaii for statewide sexual health education.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 42.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Partners in Development Foundation to provide comprehensive family training and transitional services to homeless families on the leeward coast of Oahu and for the Tutu and Me Traveling Preschool.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 43.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 for the preschool open doors program.

     The sums appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 44.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Oahu About Face Family of Programs.

     The sum appropriated shall be expended by the department of human services for the purposes of this part.

     SECTION 45.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 for domestic violence services.

     The sum appropriated shall be expended by the judiciary for the purposes of this part.

     SECTION 46.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Volunteer Legal Services Hawaii to provide pro bono legal services for indigent persons.

     The sum appropriated shall be expended by the judiciary for the purposes of this part.

     SECTION 47.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Legal Aid Society of Hawaii to provide general civil legal services.

     The sum appropriated shall be expended by the judiciary for the purposes of this part.

     SECTION 48.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, for the Hawaii Family Law Clinic to provide services to obtain temporary restraining orders.

     The sum appropriated shall be expended by the judiciary for the purposes of this part.

     SECTION 49.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Catholic Charities Hawaii to provide intra-familial sex assault services.

     The sum appropriated shall be expended by the judiciary for the purposes of this part.

     SECTION 50.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to The Children's Alliance of Hawaii, Inc., to provide child sex assault services.

     The sum appropriated shall be expended by the judiciary for the purposes of this part.

     SECTION 51.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Young Men's Christian Association of Honolulu for the operation of the weed and seed program in Kalihi-Palama, Waipahu, and Ewa Beach.

     The sum appropriated shall be expended by the judiciary for the purposes of this part.

     SECTION 52.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 for the office of community services for employment core services.

     The sum appropriated shall be expended by the department of labor and industrial relations for the purposes of this part.

     SECTION 53.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Disability Rights Center to provide advocacy service to individuals with developmental disabilities and mental illness.

     The sum appropriated shall be expended by the department of labor and industrial relations for the purposes of this part.

     SECTION 54.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Kapiolani Medical Center for Women and Children for the sex abuse treatment center for statewide sex assault services.

     The sum appropriated shall be expended by the department of the attorney general for the purposes of this part.

     SECTION 55.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 for the Families for R.E.A.L. program.

     The sum appropriated shall be expended by the department of education for the purposes of this part.

     SECTION 56.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Read Aloud America, Inc., for the read aloud program.

     The sum appropriated shall be expended by the department of education for the purposes of this part.

     SECTION 57.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Read To Me International Foundation to strengthen families and promote childhood literacy.

     The sum appropriated shall be expended by the department of education for the purposes of this part.

     SECTION 58.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2011-2012 for the HOPE probation program (Hawaii's opportunity probation with enforcement).

     The sum appropriated shall be expended by the judiciary for the purposes of this part.

     SECTION 59.  There is appropriated out of the emergency and budget reserve fund of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2011-2012 for the housing placement program within the department of human services, to assist those transitioning from a homeless shelter or other credit risky families to secure permanent housing by cultivating landlords, providing deposit or fist month rental assistance, and providing other support services.

     The sum appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 60.  The appropriations authorized by this part shall not lapse at the end of the fiscal year for which the appropriation is made; provided that all moneys from the appropriations unencumbered as of June 30, 2013, shall lapse as of that date.

     SECTION 61.  (a)  Any moneys or appropriations from the emergency and budget reserve fund that are used to meet any general fund shortfall during the 2011-2012 fiscal year shall be reimbursed from the general fund to the credit of the emergency and budget reserve fund no later than July 1, 2012.

     (b)  The director of finance may deposit moneys from the general fund into the emergency and budget reserve fund; provided that the amount to be deposited into the emergency and budget reserve fund shall not exceed the sum of the moneys expended to meet the general fund shortfall during the 2011-2012 fiscal year.

PART III

     SECTION 62.  This Act shall take effect on July 1, 2117.
