A BILL FOR AN ACT

 

 

relating to transient ACCOMMODATIONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The Hawaii Revised Statutes is amended by adding a new section to be appropriately designated and to read as follows:

     "§___ -  _  Transient accommodations; nonresident owners.  (a)  Any nonresident owner of a single-family residential dwelling, condominium unit, apartment, or townhouse located in the State who rents or offers to rent the owner's single-family residential dwelling, condominium unit, apartment, or townhouse as a transient accommodation for periods of thirty days or less shall rent or offer to rent the subject property through a real estate broker or salesperson licensed under chapter 467.  The real estate broker or salesperson shall collect rents due on behalf of the owner and shall remit the appropriate taxes to the State as required by chapter 237.

     (b)  Any nonresident owner subject to subsection (a) that does not comply with the requirements of this section shall be notified in writing by the real estate commission of the noncompliance and of the need to take corrective action within seven days of the receipt of notification.  If the noncompliance continues for longer than seven days after notification, the nonresident owner shall be fined not more than $1,000 per day for each day of noncompliance."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
