A BILL FOR AN ACT

 

 

relating to electronic prescription accountability system.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Act 268, Session Laws of Hawaii 1996, is amended by adding a new section 4A to read as follows:

     "SECTION 4A.  This Act shall not apply to veterinarians as defined in section 471-1, Hawaii Revised Statutes.  The department of public safety may determine that the requirements of this Act shall apply to veterinarians and establish the specific requirements that apply.  If the department of public safety determines that this Act or specific requirements of this Act shall apply to veterinarians, the department shall notify veterinarians licensed to practice in this State in writing of its decision no later than September 1, 2012, and shall allow veterinarians a reasonable period of time to comply with the requirements before the department seeks any sanctions against any veterinarian for noncompliance."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval and shall apply retroactively to June 18, 1996.

Description:

Exempts veterinarians from the requirements of the electronic prescription accountability system.  Requires the DPS to notify veterinarians in writing by 9/1/12 if it determines that the system or certain requirements of the system apply to veterinarians.
