A BILL FOR AN ACT

 

 

relating to construction on public lands.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 171, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§171-    Building codes and permits; exemption.  (a)  All state agencies, except the department of transportation, shall be exempt from all requirements of the building codes and land-use-permitting processes of the State and its counties for the construction of structures on public lands, as defined in section 171-2.

     (b)  At least one year prior to commencing construction, exempted state agencies under subsection (a) shall notify in writing the mayor of the county in which the construction will occur regarding:

     (1)  The resulting effects on water and sewer use; and

     (2)  The resulting effects on traffic and transportation.

     (c)  Exempted state agencies under subsection (a) shall not be subject to:

     (1)  Section 132-9; and

     (2)  Section 321-11(3).

     (d)  As used in this section, "agency" means the legislature, judiciary, any executive department, independent commission, board, authority, bureau, office, other establishment of the State, or public corporation that is supported in whole or in part by state funds, or any agent thereof."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on January 1, 2013.

Description:
