A BILL FOR AN ACT

 

 

RELATING TO SALES OF ELECTRONIC CIGARETTES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  Section 245-1 Hawaii Revised Statutes, is amended by amending the definition of "tobacco products" to read:

     "Tobacco products" means tobacco in any form, other than cigarettes or little cigars, that is prepared or intended for consumption or for personal use by humans, including large cigars and any substitutes thereof other than cigarettes that bear the semblance thereof, snuff, chewing or smokeless tobacco, [and] smoking or pipe tobacco, and electronic cigarettes as defined under section 709-908, Hawaii Revised Statutes.

PART II

     SECTION 2.  Section 709-908, Hawaii Revised Statutes, is amended by amending subsection (1) to read as follows:

     "(1)  It shall be unlawful to sell or furnish tobacco in any shape or form, including chewing tobacco  and snuff to a minor under eighteen years of age. For the purposes of this section the terms "tobacco" and "tobacco products" include electronic cigarettes.  "Electronic cigarette" or "e-cigarette" means any mechanical heating element, battery, or electronic circuit, which can be used to deliver a vapor of nicotine or any other substances, and the use or inhalation of which simulates smoking.  The term shall include any such device, whether manufactured, distributed, marketed, or sold as an e-cigarette, e-cigar, e-pipe, any cartridge or component of the device or related product, or under any other product name or descriptor.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2012.
