A BILL FOR AN ACT

 

 

RELATING TO ADULT RESIDENTIAL CARE HOMES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§321-     Type II adult residential care homes; license application; notice to public; informational meeting; notice to county.  (a)  Before acting on an application for a license to operate as a type II adult residential care home in a residential area, the department shall hold an informational hearing regarding the license application in the district, as defined in section 4-1, in which the proposed facility is to be located.

     (b)  The license applicant shall publish notice of its application, together with the date and venue of the informational meeting, in a newspaper of general circulation in the county in which the proposed facility is to be located.

     (c)  If the applicant is concurrently applying for a county permit for the proposed facility, the applicant shall notify the department of its county permit application.  The department shall then notify that county of the date and venue of the department's informational meeting and invite the county's attendance at the hearing."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
