A BILL FOR AN ACT

 

 

RELATING TO DIABETES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Diabetes and obesity are two of the biggest public health challenges facing Americans.  These diseases threaten the health and well-being of millions of Americans.  According to the American Diabetes Association, 25.8 million children and adults in the United States, or 8.3 per cent of the population, have diabetes.  Diabetes is a major cause of heart disease and stroke.  According to the Centers for Disease Control and Prevention, about thirty-four per cent of United States adults are obese.  Approximately seventeen per cent of children and adolescents aged two through nineteen are obese.

     The legislature finds that prevention measures that inform and educate the public about the risks associated with these health issues will assist individuals in achieving better health outcomes and mitigate the high costs to the nation's health care system.

     The purpose of this Act is to create a task force aimed at diabetes and obesity prevention.

     SECTION 2.  (a)  There is established the diabetes and obesity prevention task force.  The director of health or the director's designee shall serve as the chairperson of the diabetes and obesity prevention task force.  The director of health or the director's designee may designate a task force vice chairperson.

     (b)  The task force shall:

     (1)  Develop and recommend legislation related to the prevention of diabetes and obesity;

     (2)  Assemble accurate research and fiscal and demographic information to support policy development and track outcomes on diabetes and obesity prevention; and

     (3)  Research other state and county organizational policy agendas and best practices related to diabetes and obesity prevention policies.

     (c)  The task force shall comprise the following members:

     (1)  A representative appointed by the governor;

     (2)  The director of health or the director's designee;

     (3)  The director of human services or the director's designee;

     (4)  The superintendent of education or the superintendent's designee;

     (5)  The chairperson of the board of education or the chairperson's designee;

     (6)  The attorney general or the attorney general's designee;

     (7)  The director of taxation or the director's designee;

     (8)  The director of finance or the director's designee;

     (9)  The director of commerce and consumer affairs or the director's designee;

    (10)  A representative from the University of Hawaii department of public health sciences;

    (11)  A representative from the University of Hawaii John A. Burns school of medicine;

    (12)  A representative from the American Heart Association;

    (13)  A representative from the American Cancer Association;

    (14)  A representative from the American Diabetes Association;

    (15)  The speaker of the house of representatives or the speaker's designee; and

    (16)  The senate president or the president's designee.

     (d)  No members of the diabetes and obesity prevention task force shall be made subject to chapter 84, Hawaii Revised Statutes, solely because of that member's participation on the task force.

     (e)  The task force shall meet at least monthly from July 2012 to November 2012.

     (f)  The task force shall report its findings and recommendations on diabetes and obesity prevention, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2013.

     (g)  The task force shall dissolve on July 1, 2013.

     SECTION 3.  This Act shall take effect on July 1, 2012.
