A BILL FOR AN ACT

 

 

RELATING TO LANDSCAPING OF PUBLIC FACILITIES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 103D-408, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  [Wherever and whenever feasible, all] All plans, designs, and specifications for new or renovated landscaping of any building, complex of buildings, facility, complex of facilities, or housing developed by the State with public moneys shall incorporate [indigenous] and give preference to native Hawaiian land [plant species as defined in section 195D-2, and plant species brought to Hawaii by Polynesians before European contact, such as the kukui, noni, and coconut;] plants; provided that:

     (1)  Suitable cultivated plants can be made available for this purpose without jeopardizing wild plants in their natural habitat; [and]

     (2)  [Wherever and whenever possible, indigenous] Native Hawaiian land plants shall be used for landscaping on the island or islands or geographical area on or in which the species originated[.];

     (3)  This section shall not apply to the landscaping of sod or turf; and

     (4)  This section shall not apply to a historic property designated under chapter 6E.

     For purposes of this section, "native Hawaiian land plant" means any land plant species growing or living naturally in Hawaii without having been brought to Hawaii by humans and any land plant species brought to Hawaii by Polynesians before European contact, such as the kukui, noni, and coconut."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2013.
