A BILL FOR AN ACT

 

 

relating to tobacco.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 328J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§328J-     Prohibiting sale of blunt wraps.  (a)  It shall be unlawful to sell a blunt wrap to any person.

     (b)  For purposes of this section, "blunt wrap" means an individual tobacco wrapper, also known as a roll your own cigar wrap, that is:

     (1)  Made wholly or in part from tobacco, including reconstituted tobacco, whether in the form of tobacco leaf, sheet, or tube; and

     (2)  Designed to be sold to individuals.

     (c)  Any person who violates this section shall be fined not more than $     ."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
