A BILL FOR AN ACT

 

 

RELATING TO LIQUOR.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to allow Hawaii consumers to receive discounts, coupons and rebates on the combined purchase of alcoholic beverages and other grocery items.

     SECTION 2.  Section 281-85, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  It shall be unlawful for any person acting as agent or representative of a nonresident principal or for any licensee directly or indirectly, or through any subsidiary or affiliate, to give any premium or free goods of intoxicating liquor or other merchandise in connection with the sale of any intoxicating liquor; or to offer or to provide any premium or free goods of intoxicating liquor in connection with the sale of other merchandise.  Notwithstanding any other provision of this chapter to the contrary, it shall be lawful for any person acting as an agent or representative of a nonresident principal or for any licensee directly or indirectly, or through any subsidiary or affiliate, to provide a discount to the consumer, either in the form of a coupon redeemed through a retail licensee or through a mail-in rebate that the consumer sends to the licensee or its agent or representative, when purchasing intoxicating liquor in combination with other merchandise."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
