RELATING TO BUILDING DESIGN FOR PERSONS WITH DISABILITIES. Requires the Disability and Communication Access Board (DCAB) to charge fees to defray expenses of reviewing construction plans to ensure compliance with law, establishes a fee schedule to be effective January 1, 2013, and requires the fees to be deposited into the DCAB special fund.

RELATING TO THE KAANAPALI AQUATIC RECREATIONAL PARK. Requires the DLNR to establish and administer an aquatic recreational park pilot program in Kaanapali on the island of Maui.

RELATING TO THE WEST MAUI OCEAN RECREATION MANAGEMENT AREA. Requires DLNR to establish a west Maui ocean recreation management area advisory committee to advise DLNR on issues relating to the state waters within the west Maui ocean recreation management area, particularly with respect to the waters adjacent to Kaanapali on the island of Maui.

RELATING TO THE STATE WATER CODE. Prohibits any person from making any withdrawal, diversion, impoundment, or consumptive use of water for purposes of bottling for export out of the watershed without first obtaining a permit from the commission on water resource management.

RELATING TO WATER SERVICE CONSUMPTION DATA. Clarifies that a water service holder’s mailing address, amounts paid by or owed to the service holder for water or sewer services, and an individual’s service location shall not be made available for public inspection or duplication.

RELATING TO LIABILITY. Makes permanent the liability protection for state and county governments regarding the duty to warn of dangers on improved public lands and actions of county lifeguards.

RELATING TO MARINE LIFE. Establishes a special fund for the marine life conservation program, and authorizes the collection of user fees for marine life conservation districts.

RELATING TO OCEAN RESOURCES. Deletes the "one-gallon per person per day" exception to the prohibition against the removal of sand and other beach or marine deposits, except for materials inadvertently taken, such as those carried away on the body, clothes, toys, recreational equipment, and bags.

RELATING TO COMMERCIAL ACTIVITIES ON OCEAN WATERS. Authorizes the Department of Land and Natural Resources to regulate the commercial use of state waters and marine resources. Effective July 1, 2012.

RELATING TO LAND USE. Requires the land use commission, upon request, to extend the time period for which a boundary amendment is effective for at least 2 years if the appropriate county officer or agency determines that the petitioner has substantially commenced development.

RELATING TO LAND USE. Requires counties to seek declaratory ruling from the land use commission for reclassification of lands in a county general plan. Changes to the general plan take effect immediately upon approval of the reclassification by the land use commission.

RELATING TO ENDANGERED AND THREATENED SPECIES. Allows citizen suits to enforce certain conservation statutes, habitat conservation plans, and safe harbor agreements against any person. Repeals the prohibition on approval of issuance of new safe harbor agreements, habitat conservation plans, and incidental take licenses after July 1, 2012.

RELATING TO HUNTING. Prohibits DLNR from entering into leases of less than ten years for certain game management areas. Requires DLNR to seek a minimum ten year lease for the Lanai game management area. Creates a task force to promote the hunting industry on Lanai.

RELATING TO HAIKU VALLEY. Establishes the Haiku Valley cultural preserve commission to provide policy and management oversight of the Haiku Valley cultural preserve. Initiates process of conveying Haiku valley in fee simple to the department of land and natural resources.
