A BILL FOR AN ACT

 

 

RELATING TO IMPACT FEES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to require impact fees to be assessed and collected from a developer prior to the issuance of a water meter.

     SECTION 2.  Section 46-146, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§46-146[]]  Time of assessment and collection of impact fees.  Assessment of impact fees shall be a condition precedent to the issuance of a grading or building permit or a water meter and shall be collected in full before or upon issuance of the permit[.] or the water meter."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2020.
