A BILL FOR AN ACT

 

 

RELATING TO PUBLIC UTILITIES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that preferential rates for the purchase of energy for agricultural activities will support the long-term viability of agriculture in the State.

     The purpose of this Act is to authorize and encourage the establishment of preferential rates for the purchase of energy for agricultural activities.

     SECTION 2.  Chapter 269, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§269-     Preferential energy rates for agricultural activities.  (a)  It is the policy of the State to promote the long-term viability of agriculture by establishing mechanisms that provide for preferential rates for the purchase of energy for agricultural activities.  The commission shall establish, by rule or decision and order, preferential rates for the purchase of energy that is used or consumed for agricultural activities.

     (b)  Upon receipt of a bona fide request for the purchase of energy to be used or consumed for agricultural activities and proof that the energy will be used or consumed for agricultural activities, a public utility shall present the request for preferential rates to the commission for approval.  In reviewing the proposed preferential rates, the commission, in consultation with the department of agriculture, may establish additional criteria for energy used for agricultural activities.

     (c)  Preferential rates shall also be extended to eligible agricultural activities at the department of agriculture."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.

Requires the PUC to establish preferential rates for the purchase of energy that is used or consumed for agricultural activities and eligible agricultural activities of the Department of Agriculture.  Effective July 1, 2050. (HB1148 HD1)
