A BILL FOR AN ACT

 

 

relating to labeling.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 486, Hawaii Revised Statutes, is amended by adding a new section to part V to be appropriately designated and to read as follows:

     "§486-     Molokai- and Lanai-made products; certification.  (a)  The board shall establish a certification process under which any food, item, product, souvenir, or any other merchandise that is grown, manufactured, assembled, fabricated, or produced on the island of Molokai or Lanai, respectively, may contain "Molokai" or "Lanai" on the front label.

     (b)  No person shall keep, offer, display or expose for sale, or solicit for the sale of any food, item, product, souvenir, or any other merchandise that is labeled "Molokai" or "Lanai", or by any other means represents the origin of the item as being from Molokai or Lanai, unless the food, item, product, souvenir, or merchandise has been certified pursuant to subsection (a).

     (c)  The board shall adopt rules pursuant to chapter 91 to implement this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2013.

Report Title:

Board of Agriculture; Molokai; Lanai; Labeling; Certification

 

Description:

Requires the board of agriculture to establish a certification process for products containing "Molokai" or "Lanai" on the front label.  Prohibits any person from using "Molokai" or "Lanai" on the label unless the product has been certified by the board.  Effective 07/01/2013.
