A BILL FOR AN ACT

 

 

relating to information.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  The legislature finds that current technologies can facilitate increased transparency about governmental activities by allowing the general public to access state financial information online.  The purpose of this Act is to require the department of accounting and general services to develop and post periodically updated information on the Internet that shows:

(1)  Revenues, expenditures, and cash on hand in sufficient detail to allow an accurate assessment of the fiscal condition and the performance of the State;

(2)  Details regarding the progression of capital improvement projects toward completion.

     SECTION 2.  The Hawaii Revised Statutes is amended by adding a new section to be appropriately designated and to read as follows:

     "§  -    Online reporting; periodic updates.  (a)  The department of accounting and general services, in accordance with this section, shall establish, implement, and maintain a single searchable website, accessible by the public at no cost to users.

     (b)  One destination within the website shall contain the following information, which shall, at a minimum, be updated on a quarterly basis:

(1)  A chart of accounts for all general funds, special funds, federal funds, interdepartmental transfers, revolving funds, and other funds into which moneys are appropriated for the operating budget, incomplete capital improvement projects, and capital improvement projects completed less than five years prior to the date of the website's most recent update;

(2)  The amounts and dates of appropriations, allocations, expenditures, lapses, transfers of funds, means of financing, and Acts under which the amounts were appropriated; and

(3)  A summary of income received, expenditures made, balances remaining, costs incurred but not yet expended, cash on hand, and any related information that may assist the legislature and members of the public in understanding the fiscal condition of the State.

     (c)  A destination within the website that is visually distinguishable from the destination prescribed in subsection (b) shall contain the following information, which shall, at a minimum, be updated on a semiannual basis:

(1)  A listing of all capital improvement projects required to be listed pursuant to subsection (b)(1); and

(2)  A listing of the following information for each capital improvement project:

     (A)  The project title;

     (B)  The phase of the project;

     (C)  The status of the project;

     (D)  Reasons for any project delays, cancellations, or holds;

     (E)  Procurement steps taken;

     (F)  Environmental issues encountered;

     (G)  Historic preservation issues encountered;

     (H)  The names of all consultants and contractors associated with the project;

     (I)  Dates and amounts of all construction awards;

     (J)  Estimated and actual dates of construction;

     (K)  Estimated construction costs;

     (L)  The reasons why any funds lapsed; and

     (M)  All the information described in paragraphs (2) and (3) of subsection (b) that is relevant to the project.

     (d)  Every state agency shall furnish the department of accounting and general services with all such documents and information as the department may from time to time require to fulfill the requirements of this section.

     (e)  The comptroller is authorized to designate one or more state agencies to participate in the development, establishment, maintenance, and support of the website."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2014.
