A BILL FOR AN ACT

 

 

RELATING TO WAIPIO VALLEY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  Chapter 171, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§171-     Waipio valley advisory commission.  (a)  There is established the Waipio valley advisory commission within the department for administrative purposes.  The commission shall advise the department on the development of a long-term plan for ensuring the proper stewardship, preservation, and maintenance of Waipio valley on the island of Hawaii for future generations, including:

     (1)  Facilitating culturally appropriate agriculture, education, and natural resource restoration and management;

     (2)  Facilitating productive interaction between residents and users of Waipio valley to develop a common vision and make recommendations for public policy related to Waipio valley; and

     (3)  Exploring potential federal, state, county, and private sources of funding for an educational resource center in Waipio valley.

     (b)  The governor shall invite the mayor of the county of Hawaii and representatives from the following organizations or groups to participate as members:

     (1)  The Kukuihaele-Waipio Community Association;

     (2)  The Waipio Taro Farmers Association;

     (3)  Non-commercial taro farmers;

     (4)  The Bernice Pauahi Bishop Museum;

     (5)  Waipio valley small land owners;

     (6)  Friends of the Future;

     (7)  Kanu o ka Aina Learning Center;

     (8)  Hawaii county council;

     (9)  Office of Hawaiian affairs;

    (10)  Mauna Kea soil and water conservation district;

    (11)  The legislature; and

    (12)  Waipio valley kupuna.

     (c)  The commission shall elect a chairperson from among its members.

     (d)  The members of the commission shall serve without compensation but shall be reimbursed for travel and other necessary expenses.

     (e)  The commission may invite resource personnel to assist with its work, including personnel from:

     (1)  The United States Department of Agriculture, Natural Resources Conservation Service;

     (2)  The department of land and natural resources; and

     (3)  The county of Hawaii planning department.

     (f)  The commission shall submit an annual report to the legislature no later than twenty days prior to the convening of each regular session.  The annual report shall include a list of all recommendations made by the commission and the resulting action taken by the department of land and natural resources over the course of the prior year."

PART II

     SECTION 2.  The legislature finds that in January 2012, the Mauna Kea soil and water conservation district released the Waipio Valley Flood Damage Reduction and Stream Stabilization Preliminary Investigation report prepared by AECOM.  The report recommended mitigation measures at the Kawashima Waterhead and the Linda Beech Crossing to stabilize the Wailoa stream channel and protection against erosion.

     The purpose of this part is to appropriate moneys to fund flood damage and stream erosion mitigation measures in Waipio valley.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2013-2014 for the design and construction of flood damage reduction and stream stabilization in Waipio valley on the island of Hawaii.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this part.

PART III

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2050.

Description:

Establishes the Waipio Valley Advisory Commission to advise the Department of Land and Natural Resources on the development of a long-term plan for ensuring the proper stewardship, preservation, and maintenance of Waipio Valley.  Appropriates funds for the design and construction of flood damage reduction and stream stabilization in Waipio Valley.  Effective 07/01/2050.  (SD1)
