A BILL FOR AN ACT

 

 

relating to professional and vocational licensing.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 436B, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§436B-     Nonresident military spouses; requirements for maintaining license or certification by endorsement or reciprocity, or temporary license.  (a)  Any license or certification issued pursuant to section 436B-14.6 or 436B-14.7 shall be valid only for the continuous period during which:

     (1)  The nonresident military spouse is married to the service member spouse; and

     (2)  The service member spouse is:

         (A)  In good standing within the active or reserve component of any of the armed forces of the United States; and

         (B)  Stationed in Hawaii pursuant to military orders issued by the United States Department of Defense.

     (b)  Any person licensed or certified under section 436B-14.6 or 436B-14.7 shall promptly report to the appropriate authority any change in status or circumstances that may affect the person's compliance with the requirements of subsection (a) or section 436B-14.7."

     SECTION 2.  Section 436B-2, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

     ""Nonresident military spouse" means a person:

     (1)  Who is not a resident of Hawaii;

     (2)  Who is certified or licensed to engage in a profession or vocation in a state other than Hawaii;

     (3)  Whose spouse is a member in good standing in the active or a reserve component of any of the armed forces of the United States and has been stationed in Hawaii for at least one year pursuant to military orders issued by the United States Department of Defense; and

     (4)  Who possesses a current and valid identification card issued to the person by the United States Department of Defense."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
