A BILL FOR AN ACT

 

 

RELATING TO FIBER OPTICS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 440J, Hawaii Revised Statutes, is amended by amending the title to read as follows:

"[[]CHAPTER 440J[]]

TELECOMMUNICATIONS AND CABLE INDUSTRY [INFORMATION REPORTING]"

     SECTION 2.  Chapter 440J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§440J-    Fiber optic cable system required for new condominium and planned community construction.  (a)  On or after January 1, 2014, no building permit shall be issued for a new condominium subject to chapter 514B or a new planned community that does not include a fiber optic cable system that meets the standards established pursuant to subsection (c).

     (b)  Nothing in this section shall preclude any county from establishing procedures and standards required to implement this section.

     (c)  Not later than December 31, 2013, the director shall adopt, by rule, standards for fiber optic cable systems, including specifications for performance, materials, components, quality, and installation."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on January 1, 2018.
