      Status & Testimony

RELATING TO RENEWABLE ENERGY.

Amends the renewable energy technologies income tax credit to improve consistency with the Internal Revenue Code, require tax credits to be certified by DBEDT, establish an aggregate tax cap, and specify that the tax credit applies to energy properties placed in service from 1/1/2013 through 12/31/2018.  Authorizes independent power producers not currently regulated by the public utilities commission that have submitted an agreement with an electric utility company for approval by the public utilities commission by 3/31/2013 to receive tax credits authorized in calendar year 2012 for energy properties placed into service after 12/31/2012, as part of the agreement.

RELATING TO ENERGY.

Requires the landlord or lessor of a commercial property to provide written disclosure of energy costs to a prospective lessee before execution of the rental agreement.  Requires oral disclosure of energy costs to a prospective lessee for an oral lease agreement at or before commencement of the tenancy.  Allows a lessee to terminate the rental agreement, without liability, if the landlord or lessor fails to disclose energy costs.

RELATING TO COMMUNITY-BASED RENEWABLE ENERGY.

Establishes the Hawaii community-based renewable energy program. Enables utility customers to participate in a community-based renewable energy facility and benefit from the electricity generated from such a facility.  Effective July 1, 2013.

SB 372

      Status & Testimony

RELATING TO BIODIESEL.

Requires the director of business, economic development, and tourism to adopt rules requiring diesel fuel sold in the State to contain increasing amounts of biodiesel.  Requires that all state owned and operated on-highway diesel motor vehicles use fuel containing no less than twenty per cent biodiesel by 7/1/2015.  Requires distributors to file statements with the director, and makes the statements and their contents confidential information.  Adds a definition of biodiesel.  Provides penalties for violations.  Deletes the State's ethanol content requirement.

RELATING TO AIR POLLUTION.

Prohibits the issuance of permits to new and existing covered sources that will increase coal consumption and prohibits the approval of power purchase agreements that propose to burn or consume coal that will generate more than 50 megawatts of energy.

      Status & Testimony

RELATING TO THE ENVIRONMENT.

Prohibits food establishments from using expanded polystyrene foam disposable food service containers beginning 1/1/15.  Requires food establishments to use compostable food containers beginning 1/1/15.  Requires violators to pay a fine for repeated violations.  Requires the department of health to establish a list of alternative food containers to be posted on the department's website by 7/1/14.

RELATING TO THE ENVIRONMENT.

Requires food service businesses to provide customers with an option to use compostable or reusable food containers provided by the restaurant or food.  Requires signs to be posted informing customers that compostable food containers are available at no extra cost.  Requires violators to pay a fine for repeated violations.

SB 25

      Status & Testimony

RELATING TO WASTE REDUCTION.

Requires that distributors of telephone directories and advertising materials pick up unclaimed telephone directories and advertising materials within seven days of receiving a request to do so if the telephone directories and advertising materials are not made out of one hundred per cent recyclable materials.  Imposes a fine for violations.
