RELATING TO FIREARMS.

Requires county police departments to fingerprint, photograph, and perform background checks on individuals who wish to register a firearm that was procured out-of-state.  Authorizes the police departments to assess a fee for conducting a fingerprint check and specifies the amount of the fee.  Extends the time period for registering a firearm procured out-of-state, for consistency with the time period for registering firearms obtained in or imported into the State.  Appropriates funds for county implementation.  Effective 07/01/2050.  (SD2)

RELATING TO CORRECTIONS.

Allows committed persons to create and place for sale approved products and crafts. Allocates proceeds to rehabilitation programs, the crime victim compensation special fund, and the committed person's account. Requires department of public safety to study other states' practices on the making and sale of arts and crafts by inmates. Requires a report to the 2014 legislature.  Effective 07/01/2050.  (SD1)

PROPOSING AN AMENDMENT TO ARTICLE I OF THE CONSTITUTION OF THE STATE OF HAWAII RELATING TO RIGHTS OF CRIME VICTIMS.

Proposes an amendment to the Constitution of the State of Hawaii guaranteeing that crime victims and their immediate surviving family members have specific rights related to information pertaining to and participation in the criminal justice process.

Includes law enforcement animals under the offenses of causing injury or death to a service dog and intentional interference with the use of a service dog.  Adds a definition for "law enforcement animal".  (SD1)

RELATING TO COURT ORDERS TO PROVIDE MEDICAL TREATMENT FOR INMATES AND DETAINEES IN CORRECTIONAL FACILITIES.

Provides for the filing of a petition for involuntary medical treatment in either the district or circuit court; allows for a declaration to be filed with the petition as an alternative to an affidavit; expands the court's ability to continue the hearing on the petition for good cause; gives the court more flexibility in deciding when a guardian ad litem is necessary; changes the time within which a person must be examined from two days to five days prior to filing of the petition; amends the list of persons who must be notified of the petition; and clarifies the effective expiration date of the order for persons who return to custody after release.  (SD1)

RELATING TO THE STATE BUILDING CODE.

Allows the counties three years to adopt their amendments to the state building code and permits the counties to apply their most recently adopted building code until the new amendments are adopted; the state building code may be used as a reference during this time.  (SD1)

RELATING TO PRODUCTION OF RECORDS.

Amends section 306D-4, HRS, to allow for the service of process issued by another state upon a Hawaii recipient and clarifies the following:  (1) that the service of process may be upon a person or business, but not a government agency; (2) that the process is for the production of records; (3) that the process must be based upon a pending criminal investigation or prosecution; and (4) that the person or business being served must have conducted business or engaged in transactions occurring at least in part in the issuing state.  Effective 07/01/50.  (SD1)

Status

RELATING TO THE HAWAII PAROLING AUTHORITY.

Allows the chief justice, director of public safety, president of the Hawaii State Bar Association, and president of the Hawaii Chapter of the National Association of Social Workers, who serve on the panel that nominates Hawaii Paroling Authority members, to select designees to represent them on the panel.  Requires certain information regarding parole decisions by the paroling authority to be made public after a parole release hearing.  Requires three paroling authority panel members for quorum, unless there is a recusal due to a conflict of interest, then two panel members meet quorum.  Effective 1/1/2050.  (SD1)

RELATING TO THE REENTRY COMMISSION.

Replaces the Reentry Coordinator with the Director of Public Safety as an ex officio nonvoting member of the Reentry Commission.

RELATING TO EMERGENCY SCHEDULING OF CONTROLLED SUBSTANCES.

Requires the Department of Public Safety to post a public notice thirty days prior to the effective date of the emergency scheduling action, at the State Capitol, in the Office of the Lieutenant Governor, and on the department's website for public inspection.

Status

RELATING TO COMMITTED PERSONS ON FURLOUGH.

Adds child support payments as obligations for inmates on furlough who are employed and delineates percentage of earnings that shall be deducted to satisfy outstanding orders regarding restitution, crime victim compensation, other fees and fines, and reimbursement to the State for the cost of room and board.  (SD1)

Persons wishing to offer comments should submit testimony at least 24 hours prior to the hearing.  Testimony should indicate:

·     Testifier's name with position/title and organization;

·     The Committee(s) to which the comments are directed;

·     The date and time of the hearing; and

·     Measure number. 

 

While every effort will be made to incorporate all testimony received, materials received on the day of the hearing or improperly identified or directed, may be distributed to the Committee after the hearing.

Testimony submitted will be placed on the legislative website after the hearing adjourns.  This public posting of testimony on the website should be considered when including personal information in your testimony.

 

If during the course of the hearing it appears that there will not be sufficient time to allow everyone to be heard, the chairperson reserves the right to limit the remaining testifiers to three minutes.  This three minute policy will be enforced to ensure fairness and adequate consideration to all bills.
