A BILL FOR AN ACT

 

 

RELATING TO LEGISLATIVE OVERSIGHT OF PAPAHANAUMOKUAKEA.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

Legislative oversight

     §   -1  Papahanaumokuakea legislative inspection committee; established.  (a)  There is established the Papahanaumokuakea legislative inspection committee, which shall:

     (1)  Review the purpose and objectives of the Papahanaumokuakea Marine National Monument;

     (2)  In furtherance of the State's role as a co-trustee of the Papahanaumokuakea Marine National Monument,  conduct informational briefings to ensure that the federal government is in compliance with the Monument Management Plan established pursuant to the 2006 Presidential Proclamation that created the monument and the memorandum of agreement between the federal and state government;

     (3)  Examine how federal and state agencies are managing the resources of the Papahanaumokuakea Marine National Monument and responding to threats, including threats from climate change and marine debris; and

     (4)  Conduct a site inspection of the Papahanaumokuakea Marine National Monument once every three years for the purpose of monitoring the environmental protection of the site and its sustainable and fiscally responsible management.

     (b)  The committee shall be composed of:

     (1)  The chairs of the standing committees of both houses of the legislature whose subject matter relates to Hawaiian affairs and water, land, and ocean marine resources, who shall serve as the co-chairs of the committee;

     (2)  Members of the standing committees of both houses of the legislature whose subject matter relates to Hawaiian affairs and water, land, and ocean marine resources;

     (3)  The member of the house of representatives who represents the district encompassing the Papahanaumokuakea Marine National Monument; and

     (4)  The member of the senate who represents the district encompassing the Papahanaumokuakea Marine National Monument.

     (c)  The department of land and natural resources and other relevant state agencies shall assist the committee with coordination of its site visits.

     (d)  The committee shall submit a report to the legislature not later than twenty days prior to the convening of each regular session that immediately follows a site visit conducted under subsection (a)(4) regarding the status of the Papahanaumokuakea Marine National Monument.

     (e)  As used in this section, "committee" means the Papahanaumokuakea legislative inspection committee."

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2014-2015 for the purpose of coordinating and facilitating the Papahanaumokuakea legislative inspection committee site visits.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2014.

Description:

Establishes the Papahanaumokuakea Legislative Inspection Committee.  Requires the committee to ensure compliance with the memorandum of agreement that provides for the administration of the Papahanaumokuakea Marine National Monument and conduct site visits every three years.  Appropriates funds.  Effective July 1, 2014.  (HB1556 HD1)
