A BILL FOR AN ACT

 

 

RELATING TO THE HAWAII COMMUNITY DEVELOPMENT AUTHORITY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1.  (a)  The auditor shall conduct a management and financial audit of the Hawaii community development authority's governance and operations.

(b)  The auditor's management audit of the Hawaii community development authority shall include, at a minimum:

     (1)  A determination of whether the Hawaii community development authority is currently fulfilling the original purpose of its establishment;

     (2)  Whether the Hawaii community development authority is currently compliant with all state and county laws; and

     (3)  A review of accountability within the Hawaii community development authority, including an examination of whether:

          (A)  The current composition of the Hawaii community development authority's board adequately and fairly represents interests in accordance with the Hawaii community development authority's original purpose;

         (B)  The Hawaii community development authority currently has oversight procedures in place to ensure the continued accomplishment of its original purpose; and

         (C)  The Hawaii community development authority has taken appropriate steps to encourage community participation and implement community suggestions in the creation and amendment of its development plans.

     (c)  The auditor's financial audit of the Hawaii community development authority shall include, at a minimum:

     (1)  An analysis of the Hawaii community development authority's budget and whether the expenditure of its funds is in accordance with its original purpose;

     (2)  An examination of procurement procedures of the Hawaii community development authority;

     (3)  An examination of the methodology, process, criteria, and evaluation factors used by the Hawaii community development authority in determining the acceptability of contractors, lessees, lessors, and other entities having contracts with the Hawaii community development authority; and

     (4)  Whether the Hawaii community development authority has systems or procedures in place to ensure fair and equitable fiscal behavior and avoid waste and fraud, for sums, procedures, and contracts specified in paragraphs (1) through (3).

     (d)  The auditor shall submit the management and financial audit pursuant to this Act, which shall include its findings, recommendations, and proposed legislation, if any, to the legislature no later than twenty days prior to the convening of the regular session of 2015.

     SECTION 2.  This Act shall take effect upon its approval.
