A BILL FOR AN ACT

 

 

RELATING TO THE ENVIRONMENTAL RESPONSE REVOLVING FUND.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The auditor shall conduct a financial and management audit of the environmental response revolving fund established pursuant to section 128D-2, Hawaii Revised Statutes, to determine the extent to which use of the fund is meeting state and federal requirements and criteria pursuant to section 128D-2(b), Hawaii Revised Statutes, and other applicable state or federal law.

     (b)  The auditor shall also evaluate the readiness of the environmental response program with respect to measures and actions taken consistent with section 128D-2(b)(1)(A), Hawaii Revised Statutes, in preparation for an oil spill and section 128D-2(b)(2) to support environmental protection and natural resource protection programs.  As part of the evaluation, the auditor shall consider:

     (1)  Whether the current placement of the program and responsibility for the environmental response revolving fund within the department of health, which has primary responsibility for human health, has been effective in meeting the responsibility under section 128D-2(b)(1)(A) and (b)(2); or

     (2)  Whether management of the fund should be transferred from the department of health to:

          (A)  The department of land and natural resources, which has broad responsibility for the environment, natural resources, water resources, wildlife, and forestry;

          (B)  The department of defense, which has the responsibility to respond to natural and man-made disasters, such as a massive oil spill; or

         (C)  Another department.

     SECTION 2.  The auditor shall report its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2015.

     SECTION 3.  This Act shall take effect upon its approval.
