A BILL FOR AN ACT

 

 

relating to the department of education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


SECTION 1. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"302A-   School gardens. (a) All schools may grow food in school gardens for consumption in their school meals programs; provided that food products used in a school meals program shall be inspected and certified as safe by the department of agriculture.

(b) Upon request by a school, a nonprofit organization, as defined in section 302D-1, may establish and administer a fresh food distribution service.

(c) The department may adopt rules under chapter 91 to implement this section."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect on July 1, 2013.
