A BILL FOR AN ACT

 

 

relating to state funds.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the national and global economic crisis that began in the second half of 2008 has caused significant economic problems in numerous industries in the State, including the airline, cruise ship, tourist, and construction industries.  Mass layoffs have been reported by an increasing number of Hawaii businesses statewide, from the agricultural sector to the medical-services sector.  Difficult economic times and declining tax revenues have resulted in budget cuts for all state services.

     The current and impending situation jeopardizes the safety net of basic human services, health, and education needs for Hawaii's residents and families.  While all of Hawaii's residents will be affected by the situation, gap group families and families closest to the poverty line will suffer the most.

     The purpose of this Act is to appropriate moneys from the general fund to maintain the levels of programs determined to be essential to education, public health, and public welfare.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for respite services.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $            or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to supplement the healthy start program.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $            or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to:

     (1)  Catholic Charities Hawaii for the Lanakila Multi-Purpose Senior Center    $          ;

     (2)  Moiliili Community Center for the Moiliili Senior Center Program     $          ; and

     (3)  Waikiki Community Center          $          .

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 5.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the kupuna care program.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 6.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the aging and disability resource center.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 7.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the developmental disabilities medicaid waiver program.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 8.  There is appropriated out of the general revenues of the State of Hawaii the sum of $            or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for mental health services.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 9.  There is appropriated out of the general revenues of the State of Hawaii the sum of $            or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the partnerships in community living program.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 10.  There is appropriated out of the general revenues of the State of Hawaii the sum of $             or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for substance abuse treatment.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 11.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the healthy aging partnership program.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 12.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Waianae District Comprehensive Health and Hospital Board, Inc., to support its emergency room services.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 13.  There is appropriated out of the general revenues of the State of Hawaii the sum of $            or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, for HIV/AIDS related services and to be distributed as follows:

     (1)  Life Foundation                      $          ;

     (2)  Gregory House Programs               $          ; and

     (3)  Community Health Outreach Work to

          Prevent AIDS                         $          .

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 14.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to fund the housing first pilot program for chronically homeless individuals, including those who have an addiction or mental illness, or both.

     The department of human services shall submit a report to the legislature on the progress of the housing first pilot program no later than twenty days prior to the convening of the regular session of 2014.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 15.  There is appropriated out of the general revenues of the State of Hawaii the sum of $            or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for meals for the elderly for kupuna care.

     The sums appropriated shall be expended by the department of health's executive office on aging for the purposes of this Act.

     SECTION 16.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Kokua Kalihi Valley (Comprehensive Family Services).

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 17.  There is appropriated out of the general revenues of the State of Hawaii the sum of $            or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to be administered by the department of health for services to pregnant women struggling with addiction.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 18.  There is appropriated out of the general revenues of the State of Hawaii the sum of $             or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the baby S.A.F.E. (substance abuse free environment) program.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 19.  There is appropriated out of the general revenues of the State of Hawaii the sum of $          or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for fetal alcohol spectrum disorders.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 20.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for family planning services.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 21.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for perinatal health programs.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 22.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the preschool developmental screening program.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 23.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Blueprint for Change for neighborhood place walk-in centers.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 24.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Primary Care Association for the Hawaii immigrant health initiative program provided at federally qualified health centers.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 25.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to support domestic violence shelters statewide and to be distributed as follows:

     (1)  Child and Family Service;

         (A)  Two shelters on Oahu            $          ; and

         (B)  Two shelters on the Big Island  $          ;

     (2)  Parents and Children Together        $          ;

     (3)  Women Helping Women                  $          ;

     (4)  Molokai Community Service

          Council, Inc.                        $          ;

     (5)  Young Women's Christian Association

          (YWCA) of Kauai                      $          ;

     (6)  Windward Spouse Abuse Shelter        $          ; and

     (7)  Statewide domestic violence shelters $          .

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 26.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Hale Mahaolu for personal care services.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 27.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the shelter plus care program.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 28.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Primary Care Association for adult dental care provided at federally qualified health centers; provided that the funds shall not be used for any other purpose.  The governor is authorized to utilize enhanced federal medical assistance percentages funds to offset the amount appropriated; provided that the total amount shall not exceed $          .  The department of human services shall report to the legislature on:

     (1)  The number of adults receiving these benefits;

     (2)  The cost per person;

     (3)  Total breakdown of administrative costs and other overhead costs; and

     (4)  Statistics, if available, on how this dental program is reducing the number of emergency dental-related medical procedures;

provided that the department of human services shall submit its report no later than twenty days prior to the convening of the 2014 regular session.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 29.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the adult dental care program at Maui community college, University of Hawaii.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 30.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for outstationed eligibility worker services provided at federally qualified health centers.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 31.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Primary Care Association for outreach services provided at federally qualified health centers.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 32.  There is appropriated out of the general revenues of the State of Hawaii the sum of $             or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Primary Care Association for outreach services to locate uninsured children for services at federally qualified health centers.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 33.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for child care subsidies.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 34.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the general assistance program under section 346-71, Hawaii Revised Statutes, to maintain the general assistance benefit amount at $           per person per month or as close to $           per person per month as possible, given the monthly caseload.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 35.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Adult Friends for Youth for youth gang prevention and intervention services.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 36.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Hawaii Centers for Independent Living for statewide independent living services.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 37.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Susannah Wesley Community Center for the Susannah Wesley Community Center Youth Service Center.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 38.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Planned Parenthood of Hawaii for statewide sexual health education.

     The sums appropriated shall be expended by the department of health for the purposes of this Act.

     SECTION 39.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Partners in Development Foundation to:

     (1)  Provide comprehensive family training (early childhood, parent, adult education, and intensive child-caregiver activities) and transitional services to sheltered and unsheltered homeless families on the leeward coast of Oahu;

     (2)  Offer early screening, assessment, and referral services for homeless children from birth to age five; and

     (3)  Prepare homeless children for kindergarten by providing developmentally appropriate social, emotional, and cognitive activities in a child-caregiver interactive learning environment.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 40.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to PATCH (People Attentive to Children) for the preschool open doors program.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 41.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for domestic violence services.

     The sums appropriated shall be expended by the judiciary for the purposes of this Act.

     SECTION 42.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Volunteer Legal Services Hawaii to provide pro bono legal services for indigent persons.

     The sums appropriated shall be expended by the judiciary for the purposes of this Act.

     SECTION 43.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Legal Aid Society of Hawaii to provide general civil legal services.

     The sums appropriated shall be expended by the judiciary for the purposes of this Act.

     SECTION 44.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, for the Hawaii Family Law Clinic to provide services to obtain temporary restraining orders.

     The sums appropriated shall be expended by the judiciary for the purposes of this Act.

     SECTION 45.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Catholic Charities Hawaii to provide intra-familial sex assault services.

     The sums appropriated shall be expended by the judiciary for the purposes of this Act.

     SECTION 46.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to The Children's Alliance of Hawaii, Inc., to provide child sex assault services.

     The sums appropriated shall be expended by the judiciary for the purposes of this Act.

     SECTION 47.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Young Men's Christian Association of Honolulu for the operation of the weed and seed program in Kalihi-Palama, Waipahu, and Ewa Beach.

     The sums appropriated shall be expended by the judiciary for the purposes of this Act.

     SECTION 48.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the office of community services for employment core services.

     The sums appropriated shall be expended by the department of labor and industrial relations for the purposes of this Act.

     SECTION 49.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Disability Rights Center to provide advocacy service to individuals with developmental disabilities and mental illness.

     The sums appropriated shall be expended by the department of labor and industrial relations for the purposes of this Act.

     SECTION 50.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Meth Project for methamphetamine use prevention programs.

     The sums appropriated shall be expended by the department of the human services for the purposes of this Act.

     SECTION 51.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 for the Families for R.E.A.L. program.

     The sums appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 52.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to Read Aloud America, Inc., for the read aloud program.

     The sums appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 53.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Read To Me International Foundation for reading programs for children of incarcerated parents.

     The sums appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 54.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide funding for grants pursuant to chapter 42F, Hawaii Revised Statutes, to the Hawaii Primary Care Association for health care services for uninsured persons.

     The sums appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 55.  (a)  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to the department of education for the following purposes:

     (1)  Providing non-school-hour programs that include child-care programs; arts and crafts; hula and ukulele lessons; tutoring; education classes; remedial classes; sports and recreation programs; career exploration programs; self-improvement activities; leadership programs; environmental stewardship opportunities; financial education; cooking and other life skill classes; cultural enrichment and exchange activities; and other programs and recreational projects; and

     (2)  Purchasing or leasing of vehicles by a school to furnish students with transportation to travel to and from school to attend programs and classes described under paragraph (1), if those programs or classes are held at places other than the school.

     (b)  The sums appropriated in subsection (a) shall be allocated to the counties of Hawaii, Honolulu, Kauai, and Maui in an amount equal to forty per cent as provided in paragraph (1), to the department of education in an amount equal to forty per cent as provided in paragraph (2), and to the office of youth services in an amount equal to twenty per cent.  For the amounts allocated to the counties and the department of education, each county and school shall be allocated moneys as follows:

     (1)  For counties, in the same proportion as the number of students in each county in relation to the total number of students in the State; and

     (2)  For the department of education, each school to receive an amount based on the weighted student formula under section 302A-1303.6, Hawaii Revised Statutes.

     (c)  The sums appropriated shall be expended by the department of education for the purposes of this Act.


     SECTION 56.  This Act shall take effect on July 1, 2013.
