A BILL FOR AN ACT

 

 

RELATING TO PUBLIC LANDS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 171, Hawaii Revised Statutes, is amended by adding a new section to part I be appropriately designated and to read as follows:

     "§171-     Permit fees.  (a)  The board shall adopt rules pursuant to chapter 91, that establish a fee schedule for issuing permits to private applicants to stage events taking place on public lands.  The permit fees shall be as follows:

     (1)  For a permit issued to an applicant that is recognized by the Internal Revenue Service under section 501(c)(3) or 501(c)(6) of the Internal Revenue Code, the fee shall be no less than $          ;

     (2)  For a permit issued to any other applicant, the fee shall consist of:

         (A)  A base fee of no less than $          ; and

         (B)  An amount equal to            per cent of the gross receipts derived from the event.

     (b)  Nothing in this section shall prohibit the board from establishing additional permit fees for staging events taking place on public lands.

     (c)  As used in this section, "event" means a one-time occasion of a limited duration at which:

     (1)  Twenty-five people or more are expected to gather or attend; or

     (2)  A structure will be erected."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on January 1, 2016.
