A BILL FOR AN ACT

 

 

relating to massage.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 452, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§452-     Prohibited practices.  (a)  It shall be unlawful for any person licensed under this chapter, for compensation, to knowingly perform or offer or agree to perform on any massage client any act that would constitute "deviate sexual intercourse", "sexual contact", or "sexual penetration" as those terms are defined in section 707-700.

     (b)  In addition to any other penalty prescribed by law or rule, any person whose massage therapist license is revoked pursuant to section 452-24 as a result of a violation of this section shall be ineligible to reapply for a massage therapy license under this chapter."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
